roborated by an exhauutlve cross-ex-amlnatlon
at Pendleton yesterday.
There Is yet a warning to be sent to
the farmers of Union county who were
swindled Into signing an agreement
that waa a downright piece of crook
edness, according to a statement of
the railroad commission Itself. That
warning is to Ignore the contracts and
for farmers to reap the benefit oi
rate reductions if full If the rate
are reduced. When the hearing at
Pendleton has reached a decision It If
probable that the grain rates from
the Grande Ronde will be reduced,
and in that event those who signed a
contract with Gaines to split the re
ductions, will either be "held up" b
adhering to the contract, or realize SO
per cent more profit by the rate re
duction. . .
Following is what the Pendleton
East Oregonlan says of the man who
attempted to swindle the principal
wheat farmers of this valley:

VV. Gaines, who under contract with
several farmers, has endeavored to
secure a reduction or tne gram rates
In force In this section for one-half
the sum saved the first year by such a
reduction, was made evident in' the
grain rate hearing at the Commercial
association rooms yesterday. It was
also made evident that the commis
sion's action In hearing the matter
yesterday was not affected by Mr.
Gaines, with whom the commission re
pudiated any connection whatsoever.
It was brought out during the hear
ing that Gaines had made representa
tions to the farmers that he could ef
fect a saving in the rates on the O. R.
&'N. for transporting wheat to Port
land and contracted to secure such a
reduction for one-half the first year"

pression was given out that the man
represented hehad some connection
with the commission and in the grill
ing given the witness when Gaines wat
put on the stand yesterday afternoon
the commission left It evident that it
methods used. It was also shown that
the present hearing was in no way
connected with any act of Mr. Gaines,
but was taken up by the commlssior.

Gaines' Methods Condemned.
A contingent fee, such as was ar
ranged by Gaines, was roundly con
demned during the course of the hear
ing, and although the commission had
no condemnation for an organization
of the farmers to secure legal assist
ance in a fight for better rates, its dis
gust with the Gaines plan was very
plain.
Gaines, as a witness, was, thoroughly
posted upon many features of ,the rat
problem, and declared that the pres
ent charges of the company were o
per cent In excess of what was needec1
to pay all expenses and a return of (
per cent on the investment
C. A. Barrett of Athena, was also
a witness yesterday before the com
mission and testified to farming con
ditions and farm values In the coun
ty. The evidence taken by the commis
sion in this city will be used by It to
base its final opinion after hearings at
several other points along the line of
the rlalroad are held. Next week the
commission will hold another hearing
at Heppner, and later one will be held
at The Dalles.

The boys were arraigned before

and will take the young men to that
