NEARLY LOCAL OPTION
Olympla, Oct. 27. What in effect Is
almost equivalent to a local option law
Is already contained In the statutes of
this jjtate, under a ruling of the su
preme court in an opinion Just handed
down. This law, ns construed by the
supreme court; gives city councils au
thority to regulate, restrain, license or
prohibit the liquor traffic, without hav
ing their proceedings subjected to
court review.
In the case in question the City of
Puyallup last June revoked all out
standing liquor licenses and provided
for the refund of license money ad
vanced by the liquor dealers.
In a previous case the supreme court
has held that the city council had ex
clusive Jurisdiction in revoking a 11
ci8e for cause. In the Puyallup case
the order of revocation was not based
on causo.
William Meservey and George West,
who possessed' an unexpired liquor li
cense, sought a writ of review In the
superior court, and the city applied
to the supreme court for a writ of pro
hibition restraining the lower court
from proceeding under the writ of re
view. "...
The supreme court grants the writ
of prohibition, holding that the Juris
diction of the city under Section 5714,
Pierce's code. Is exclusive."
Under Jhfci provision, it is therefore
only necessary for the people to elect
an anti-Baloon city council to abate the
liquor traffic In such city.
