& N.. was called upon to testify for
the state.
The state rested its case shortly af
ternoon today when Attorney Illnkle,
representing the defendants, closed a
grilling cross-examination of the wit-1
ness Bannister.
Tom Whitney, the Thlel detective.
Bannister, who accompanied him to
act aa witness In the transactions upon
which the prosecution Is based, and
Mr. Qulnlan were the state's only wit
nesses.
Whitney told of purchasing what he
declared to be a mixture of ice, whis
key and ginger ale at "Billy 4c Dick's"
on September 12, and declared that he
had purchased the same concoction
on other occasions.
He was positive as to the whisky
being Included In the mixture and tes
tified that after drinking several simi
lar "highbuy" In various resorts along
the street, he was under the Influence
f liquor to an appreciable extent.
