I wo cases of . unusual Importance
were' up for consideration In the cir
cuit court yesterday afternoon and al
most the entire afternoon was taken
up with, arguments upon demurrers,
says the Pendleton Eaat Oregonlun of
Friday. .
One of the cases Is the criminal ac
tion brought against M. J. Buckley
and other officials of the O. R. & N.
company for alleged violation of the
14-hour law while the other case was
that of Murtin, et al vs. the O. H. &
N. company, an action which Involves
the reciprocal demurrage provision of
the present Oregon railroad law.
At the conclusion of th nrrnmont
Judge Bean took the cases under ad
visement and he will not likely pass
upon either one until fall.
Say State Law Was Void.
In the case against the railroad of
ficials the contention of the defense
was that Oregon's 14-hour law was
void at the time the violation occurred
because congress had already passed
a law upon the subject.
The state law was passed In Feb
ruary, 1907, and in March of that
year the national law was passed.
However, the federal law did not go
Into effect for a year an4 during that
time the alleged offense, occurred.
In arguing the case yesterday, At
torney Spencer, for the railroad com
pany, held that even If the federal
law had not yet come Into force the
state law was void anyway..' because
the national congress had passed leg
islation on the subject.
In reply District Attorney Phelps
contended that the state law was ef
fective until the federal law- went Into
force. In support of this stand he
urged that If such were not the case
congress could nullify state legislation
at any tlmo by passing laws upon the
same, subject, with provisions that the
national laws would nut go Into effect
for one, five or more years.
