the second degree in the circuit court

the two were driving out to a hay
ranch in a hack. The murderer struck

from Heprner to Echo, then to Pen
dleton and was later found working
on a ranch near Spokane. He waa
taken back and the case went to trial

put up a strong fight, but as he was

behalf and as all the circumstances
tended to show that he was not Justi
fied In the killing, the jury brought in

' At 1:10 this afternoon. Judge Bean
sentenced the murderer to life Impris

. Dan Doherty, recently found guilty
of murder In the second degree In the
same court, has not been sentenced yet
and probably will not' be for some
time, as' his attorney, Judge Fee of
this city, has filed a motion for a new
trial.
District Attorney Phelps, having
completed the prosecution of the
criminal cases before' the. Morrow
county court, left for home this morn
ing and will arrive in Pendleton this
afternoon on the Portland local.
