- It has become known that the sen
sational land fraud, charges against
leading business ' nun of Pendleton
and Umatilla county, became possible
Monday afternoon through the inves
tigation of Captain J. H. Alexander, a
special land office agent who for many
years made his home In this city and
even now claims La Grande as his
home town, though he, has been trans
ferred to other reservations In this
state. Th Portland Telegram of yes
terday. In reporting the results of the
grand Jury which was called by Dis
trict Attorney McCourt to probe the
findings ot the special Investigation,
iays:... . .... .,,.,,'; . , .
As the result of the action of the
federal grand Jury, empaneled to In
quire Into the alleged Umatilla reser
vation land frauds, In returning seven
true bills yesterday, 11 well known
residents of Pendleton and Umatilla
county stand accused of conspiring to
defraud Uncle Sam out of 10,000 acres
of government land.
After deliberations covering a period
of two weeks, during which time the
testimony ofover 100 witnesses was
taken, the federal Inquisitorial body
concluded the bulk of Its labors yes
terday afternoon when they filed lnt(
the United States circuit court anr"
returned Indictments against 3. H
Raley, William Slusher, Alonzo Knotts,
John W. Crow, John M. Wynn, Wll
ilam Caldwell, C. W. Mathews, John
Vert, Bailey Ross, Samuel Olmstead
ind William Rahe.
Warrants for the arrest of the In
dieted men have been Issued by Judge
Wolverton and placed In the hands ot
the United States mrashal for service.
The warrants are on the way to Pen
dleton for service, and the alleged
oonsplrators against the government
will soon be in custody. It Is expect
ed that the majority of the defendant!
will be arrested within a few days
nd arraigned In the federal court be
fore the end of the week.
The grand Jury Is still considering
Umatilla land fraud matters, but ac
cording to United 8tatea District At.
torney McCourt no further Indict
nenta will be returned today.
J. H. Raley, who Is charged In six
if the seven bills, has been prominent
In eastern Oregon politics for years.
and Is a lawyer of standing; Blushei
was the Joint representative from Mor
row and Umatilla Counties In the last
legislature; Knotts, Crow. Wynn, Cald
well and Mathews are wealthy sheep
men; ert was formerly connecteC
-vlth the First National Bunk of Pen-
ll-ton; Hons and Olmstead are wooe"
dealers, and Raho : has been engaged
rt training horses.
The Indictments filed allege a viola
Ion of section 5440 of the United
States conxplinry stattitt-s, and charge
he deft-ndnnts with having solicited
mil procured persons to mnke false
ind fraudulent affidavit! for the pur-
'hnie of I'mattlla land and for
u)ii.-l.:ratlon Induced the applicants
o niske contracts at th etlme of ap
Plication that the lands acquired
'hnuld Inure to the defendants.
The land which Raley et al. are al-
'eged to hove attempted to grab is lo
cated In townxhlp 12 and 1 Indus
ve, and was orlKlnally a portion ol
he Umatilla Indian reservation. An
let of congrrns In 1885 provided 'for
he su.'e of the lands at public auction
In tracts of not greater than 1(0
teres of non-timbered, and 40 acres
f timbered. It was expressly pro
vided In the act that the land was to
be cultivated and title was not to Inure
to any other person than the appll
cant. Provision was also made for the
payment In Installments covering a
"d of five years.
As too lands did not sell readily
-"-nereis amended the law In ItOf
providing for private sale, but the
provisions of the o:lglnal bill relative
to cultivation and residence, were not
repealed.
The evidence presented to the grand
Jury showed that Raley, Btunher and
the others employed enlrymen lot
considerations rsnglng from 150 tr
1100 to take up the land upon the dis
tinct understanding that upon final
payment title was to revert to them.
In this connection It is claimed thai
Olmstead. Roes and Rahe. by reason
ef their wide acquaintance In Umatilla
county, were hired to secure dummy
enlrymen.
la 1104, Captain 3. H. Alexander
waa appointed a special ageat at La
Oraade, aad noting the uaueoal ac
tivity in the sale of Umatilla lands,
started a quiet investigation. As the
result of his report to the interior de
partment, special Agent Dixon was
sent out to make an investigation.
Dixon commenced his labora In 1906,
but It was not until a year later that
the Investigation was completed. .
After reviewing the evidence the In
terior department referred the mat
ter to United States District Attorney
McCourt McCourt at once asked for
the calling of a grand Jury, and In less
than two weeks the indictments have
been returned." '
