Upholding the validity of the Inltia
tlve referendum amendment to the
'state constitution. Presiding Judge J.
n. Cleland, In the state circuit court
this morning, sustained the demurrer
filed by the state attorney general to
the answer of the Pacific Slates Tel
uphon & Telegraph company. In
which the attack upon the Initiative
and referenduc was made.
In accordance with a prearranged
plan, formed for the purpose of
bringing the test case into the su
preme court of the United States at
the earliest possible moment, the
Questions Involved were submitted
this morning without argument, as It
was considered the local circuit court
would be bound by the decision of the
state supreme court in the case of
Kaderly vs. Portland. Judge Cleland

Attorney Harrison Allen, for the tele
phone company, gave notice of appeal
to the state supreme court.
Incidentally with sustaining the de
murrer. Judge Cleland, at the request
of Attorney General Crawford, direct
ed that Judgment be entered in favor
of the stae for $10,450, this being the
amount for which suit was brought

When the attorney general brought
suit to enforce the payment of the tax

council of the city of La Grande has

to be Improved by constructing cement
sidewalks on and along the same as
follows: That a cement sidewalk seven
feet wide be constructed on Depot
treet from Its intersection with Fourth
street to the south line of the Mahaf
fey brick building: also a cement side
walk seven feet wide on Fourth street;
along lot 4, in block 103, In Chaplin's1
addition to La Grande; a!so cement
sidewalks, 12 feet wide, along lots 1,
J, 4, 5, 6, ".and 9, In block 108. and
on the east side of Elm street, from
Washington avenue to Adams avenue;
also along the north side of Adams
avenue, from Chestnut Street to Fourth
street; and along the west side of Fir
street, from the north side of Jeffer
son avenue to the south track of the
O. R. & N. Co.
Alt of said walks to be built at the
expense of the owners of the property
abutting on said portions of said

of ordinance No. S07, series 1906, and
