Mayor Eugene E. Schmltz expects to
leave the county jail today as a result
of a decision of the supreme court on
the decision of the appellate court.
Schmitz got Into communication with
friends by telephone and Is announc
ing for his release at once. Even with
the extreme cases dismissed, Schmttz's
bail will be 1330,000, but the former
city executive will find no difficulty
in this regard, as 'he was appeased
this, morning when wealthy friends
called him up and congratulated him.
i think that I'll breathe fresh air
again," said the ex-mayor, when asked
to express himself concerning the de
clslon. "In the meantime I will say
nothing."
Late today Schmitz will appear In
Judge Dune's court, where his attor
ney's will make motion for the dl'
missal of the Indictments.
The decision of the supreme court
was one of unanimity and was handed
down last night. It rules that tho up
pellate court was in the right when It
denied the prosecution the right of a
rehearing In the graft cases.
