"Stak" circular refute to die. ' At-
. tempts have been made to chloroform
n, and forgot the whole transaction,

eral times each day either the circu
lar or Its content can be heard aa
' ttie subject of discussion. The little
pink missives have become so scarce
that It not uncommon to see two-bit
and four-bit pieces offered for one
hen It Is placed In sight. .
Now, however, ' the pendulum Is
winning the other way. Home one

Ministers' association sent the follow
ing statement, duly signed by each
'member of that body, to the Herald

We, the Ministers' association, have

Smith are untrue and therefore has

the unqualified declaration that dur
ing the second trial of the Fuller case,
the trial ' In question, Judge Smith's
conduct was absolutely Irreproachable.
Also the jurors as far as interviewed,
say the same thing. One of the at
torneys In this trial further said that
Judge Smith was the best judge he
every saw. absolutely fearless and Im
partial. We further apologise to the judge
and to the public for allowing these
charges against the Judge to get Into
our circular for the following reasons:
1. The charges were entirely Ir
relevant to the purpose of our circu
lar. Judge Smith believes in the en
forcement of the' laws as much as we
do.
2. We blundered In not seeking an
Interview with Judge Smith before
publishing anything against him. We
did Interview the other officials whom
we mentioned. The blunder evidently
was made through' the hurried man
ner and limited time in which the
circular was prepared.
S. With humility we confess unfor
tunate a thing as the testimony of the
condemned men, Fuller and Parker,
to creep Into our circular. We abso
lutely abhor such a proposition as
fellowship with criminal In so noble
a cause as that of law-enforcement
and civic righteousness.
4. We want nothing but what is
absolutely clean and fair and Just
and true. We want the public to
know that we are In for fair play and
that we are Just aa fearless and vig
orous to correct a mistake as we are
to piihh a righteous campaign against
the lawless open-town policy.
We thank the public for the en
couragement given the movement thus
f.ir. We assure them that they can
depend upon us for fair play.

For the recovery of delinquent
taxes amounting to 192,000, the board
of county commissioners yesterday In
structed the county attorney to bring
suit against the O. R. tc N. railroad
company to terminate a protracted
litigation that has been in progress
for more than one year, says the
Union. For their 1905 taxes which
became delinquent In 1906, the com
pany la Indebted to the county in th
sum of t3K.SS5.86. For the 1901
taxes, delinquent In 1907, the com
pany owes 124,042.24. As yet the
company has made no effort to settle
their taxes for the year 1907, which
became delfnquent in June, 1908
amounting to $32,841.91. The as
sessed value of the O. R. ft N. prop
erty to 11,622,990.
Last year, suit was brought by the
company to recover the taxes due,
but the railroad secured temporary

from issuing a certificate of delin
quency, that the property might be
attached, and the money secured. At
this stage of the litigation, the case
rested; but will now be renewed by
the county and prosecuted with vigor.
The railroad company holds that the
rate of taxation to exorbitant

AT RAMI
Caldwell, Idaho, Feb. 6. The : re
ports brought back by Fred McCon
nell, city engineer, after his visit U
the coal mines at Roswell, are very
glowing and indicate that the pros
pects are good for development tc
show good deposits.
The mine Is situated 12 mile
from the Oregon state line and 14
miles southwest of Roswell. Rocky
presence of coal below and two tun
nels have been run, one about 900
feet and the other 500 feet.
Coal In the longer tunnel Is not ol
a superior quality until It reaches tc
about the 900 foot line, but from there
on in as far as they have, gone the
quality Is that of the Lehigh valley
anthracite. The vein Is about 14 feet
wide In the long tunnel and 11 feet
In the short one. Three men are at
work and mules -are used to pull the
cars back and forth. The developer
of this claim are Charles Lyons and
a Mr. McOuffey. Other prominent
men are said to be interested as silent
partners, and some . of these ' arc
thought to be successful promoters.
The mine Is especially well located
within a mile and a half of a remark
ably fine power site. The Owyhee
river flows through a narrow canyon
at this place and though the fall In
the river la not very great, the "cur
rent to swift and capable of produc
ing unlimited power. With these con
ditions It is not difficult to imagine
power lines running to the new mines.

house continues to supply all demands
made upon It for water in the shops

stalled air lift, when completed, will
aid In securing more water late In the
year. With the present status of
business, the demands nre not nearly
so great as they will be later on whin

necessary. When the "pick up" in
business takes place, the air lift will
he completed and It Is believed the
well will continue to meet the In
creased demand for water.

The Normal basketball team defeated
the Pearson academy team by a score
of 44 to It on January 31, and Jan
uary 24 the Waltsburg team was
beaten by a score of 69 to 12.
The E. O. 8. N. has one of the
fastest teams In this part of the
state and has a bright outlook for the
future. Games have been arranged
with Pearson's academy on February
7 and with, Waltsburg high school on
the 8th.
The Junior class gave a very suc
cessful reception Saturday night, Feb
ruary J. The entertainment consisted
of scenes from Hiawatha, acted out
In pantomime. The chapel was beau
tifully and artistically decorated In
evergreens. Refreshments were serv
ed from wigwams set In pine groves
at either end of the chapel.
An Illustrated art lecture will be
given in the Normal chapel February

The Lincoln Debating society Is
contemplating a series of debates.
They will doubtlessly be with the Pen
dleton high school.

The negro who cut an air hose on
a passenger train at North Powder
some time ago and who was commit
ted to the Insane asylum soon after,
has ben discharged and has started
east, according to Information re
ceived at the court house today from
Milem.
Funeral Today.
The funeral of the late J. J. Clegg,
who died at the family home In this
city Tuesday. February 4. of pneu
monia, was held this afternoon from
the I.. D. 8. church. The deceased
leaves a wife and grown children.
