An ordinance to license, tax, regu
late and restrain the sale of malt,
vinous and splritous and other Intox
icating liquors In bar rooms, saloons,
drinking shops and any other place
or places In the City of La Grande,
or provided for in thia ordinance and
to repeal ordinance No. t, series
1890, entitled "An ordinance provid
ing for licensing bar rooms, saloons
and drinking shops; and to restrain
and regulate the sale of malt, vinous
and splrltoirs liquors." .
The City of La Grande does ordain as
follows:
Section 1. No person or persons
shall. In the city of La Orande, Ore
gon, directly or Indirectly, in person,
by agent or otherwise, sell, barter or
deliver or permit to be sold, bartered
or delivered for, or on his or their
account or at all, any vinous, splritous
or malt or other Intoxicating liquors,
whether they be drunk on the prem
ises owned or occupied by him or
them, or otherwise, or shall sell, bar
ter, or deliver In any manner, such
liquors or nny Intoxicating liquors,

ing a license therefore in a manner
hereinafter provided. And every per
son to whom such license shall be
grxnteil, shall first pay Into the city
treasury of said city of La Grande, the
sum of 11000.00 per annum. In ad
vance, when said license Is granted
for a full term of one year; provided
that a license may be granted under
this ordlnnnce for a period of less than
one year, but not for less than six
months, lit the rate of $1000.00 per
annum.

Sec. 2. Any person wishing to sell
splritous, vinous, malt or rfther intox
icating liquors of any character, with
in the city of La Grande, Oregon, ex
cept a legally authorized druggist,
muxt first file a written petition with
the city recorder setting out the term
for which he desires a license to so
sell such liquors, the place and char
acter of the business, where he pro
puses to sell such liquors, together
with tho receipt of the treasurer of
the city for the amount of such li
cense, together with a bond signed by
not less than two good and sufficient
sureties, to bo approved by the coun
cil lit the meeting thereof where such
license Is grunted, which petition, re
ceipt and bond must bo considered by
the council which shall first find
that tho petitioner Is a suitable per
son to bo licensed to sell such liquors;
and, second, that. tho place and busi
ness to be cnrrled on where such
liquors shall be sold under snld li
cense shall not In any way, by exam
ple or otherwise, Inconvenience the
public or endanger the morals of
said city; third, that the petitioner
will be likely to perform the condi
tions of his bond; and, fourth, that
the council believe that In so selling
such liquors at said place, the peti
tioner will not during the term for
which the license la to be Issued, vio
late any law of the state of Oregon,
or any ordinance of thia city, and for
any of the reasons above set forth,
the council shall have the right, and
It shall be their duty, to refuse to
grant or Issue a license to any appli
cant or petitioner."
. Sec. 3. That if upon the filing of
such petition and the payment of said
license fee a majority of all the mem
bers of the council present, shall ap
prove said petition, and the petition
er shall file, and the council approve
a bond for such license In the fol
lowing form, then said license shall

breaches of the peace, or disturbance
of public order, by noisy, riotous or
lisorderly conduct upon the prem
