The supreme court has granted ex
Councilman E. W. Bartlett, who was
tried Jointly with ex-Councilman S. A.
Gardinler, and convicted of extortion
and who was sentenced to 10 months
In the county Jail. Gardlnler served
his time, but Bartlett made a motion
for a new trial, which was denied by
the presiding Judge, William Smith,
from which decision Bartlett appealed
and the supreme court granted him a
new trial, which In all probability will
be heard at the February term of
court. This may prove to be a more
Interesting trial In some respects than
the first, as It Is understood that Gar
dlnler will testify in a different man
ner than before. The following Is the
position taken by the supreme court:
The defendants were charged with
enlng to accuse certuln persons with
gambling and to prosecute them there
for. At the trial defendants testified
In their own behalf and In Instructing
the Jury the court said that "you are
not bound to consider th qHmrmy a
defendants as absolutely true, nor as
equal to testimony, of disinterested
witnesses. You are to bear In mlml
that the defendants speak In their
own behalf to discharge themselves
of a crimlnul accusation, and jou are
to consider the great temptation which
one so situated is under, so to speak
as to procure his acquittal."
The court holds that this language
'seeiiiB to leave an Implication that It
was Incumbent upon the Jury to con
sider the defendant's testimony as
false, and for that reason to reject It."
Hence new trial is ordered.

The public school reopened Mon
day after a two weeks' vacation, and
now everything Is In running order
for the next five months' work.
Mrs. Effie Shipley of Portland, vis
ited with Mrs. Eliza Hunter and fam
ily on Tuesday. .
The Misses Minnie and Lilly Hol-
man, stuaenjs in western oune qui
ntal, returned to Weston Thursday,
after spending the holidays with their
parents east of town.
William Cpence left Sunday night
for Corvallls, where he will continue
his studies In the Agricultural college.
Just recently there has been placed
a fine monument at tne grave oi n-
llam G. Hunter, in the Ackles ceme
tery, north of town.
Our Sunday school Is growing In
numbers right along, contrary to the
usual prediction, there has been no
falling off since Christmas, but a de
cided Increase. The officers, teach
ers and pupils are putting forth their
best efforts in the work.
A few In the Island are congratulat-
ing themselves during tne present
light" situation, that they do not
have to revert to lamps or canaies.
The dynamos at the P. F. M Co.
furnishes light foi the mill, church
and the several homes which had been
using electricity.

WELL KNOWN PIONEER.
R. R. Thompson, possibly the first
millionaire Oregon, whose- fortune
was practically made in this state, is
now lying at death's dour at the age
of 88, at his home In San Francisco,
where he has made his home during
the last few years. Thompson made
his money In steam boating on the Co
lumbia river, and for many years re
ceived 8100 per ton on all freight car
ried. Afterthe success of this under
taking he, with J. C Alnsworth, S. G.
Reed and D. F. Bradford, Incorporat
ed the old well known Oregon Steam
& Navigation company, which oper
ated for years between Portland and
Umatilla, and later was absorbed by
the O. 11. & N. company.
