The City of La Grand does Ordain a follows: j Section 1. No person or person shall occupy any portion of any street or side walk for the deposit of building material, or for the construction or repair of any building, or for the removal of any buildings, without first obtaining a permit therefor as herein provided. Section 2. Applications for permits shall be in writing, and shall specify if for building purposes, che name of the streets where located, the number of the loc and block, the size and description of the building to be constructed; or if to be repaired, the character of the repairs, the space in front of the lot or lots needed, and proposed time for completing the work; materials to be used; the name of the owner; and the estimated cost of such building or repairs, as the case may be ror the removal of a building or buildings, the application shall state the number of the lot and block upon which the same is located, the size of the building, the num ber of the lot and block to which it i. proposed to remove the am. the route to be taken, and the leneth of time re quired for such removal; the nature of the repair thereto or alteration therein, if any; the estimated cost thereof: the name of the owner and the nam of the street or streets where the same is to be re moved to. bECTiON i. Permits shall be issued hv the City Recorder upon the approval, en dorsed upon the application, of tne Com mittee on Street. A record thereof, shall be kept by the City Recorder settinc forth in a concise manner the description of the property, nam of owner, cost of th building, and th object for which the permit was granted. He shall imme diately upon granting such permit, notify me street superintendent of it content, and th use of a street or street j-der such permit shall be under the super vision of the Street Supecinterident. No permit shall be issued for a longer period than 90 days. Section 4. Th application for uch permit for building purpose shall (tat the width of that portion of the street proposed to be used, and thi number of days for which the use of said street wil be needed in the construction of said building, Whenever the recipent of a building permit shall desire to occupy or in any wise obstruct more than one half th width of the sidewalk or street in front of snch proposed building, it shall be the duty af each re:ipient of such building permit to erect and maintain during all all the time covered by sucn permit, a safe and substantial board fence not less than four feet high along the curb line of the sidewalk in front of and across the sidewalk at each endGf the tract, lot or part thereof, upon which such building is to be constructed, and also to construct and maintain and keep unobstructed and well lighted a safe and substantial pUnk s.dewa.k three feet wide along the euro lino in front f such proposed buildm,-;. and extending three foet into the wagon way, and reach three feet beyond each end of such fence along said curb line: and the issuirg of a permit shall not be construed as authorizng any person to in any wise obstruct the footWilk herein before described; Provided, that as soon as the first story walls of such building shall have been erected, the parties or partv taking out such cerinit shall con struct a substantial and well lighted cov ered way over the sidewalk in front of such tract or lot, leav.ng such sidewalk open for public use. and thereuqon such party snan oe entitled to a permit for the use of such portions of the street or streets as may not interfere with existing rights, and subject to such limitations and requirements as may be stated in such permit, and such footwalk as herein provided shall thereafter be removed from the roadway. Upon application for per mit for the removal of a building or build ings the same shall state the route and mode of such removal, and the number of days for which the permit shall be ap plied, and together with an endorsement thereon by the Street Committee of such restrictions as the public interest may re quire. The Street Committee may at its discretion require applications for permits to give security by deposit or otherwise and any damages that may occur by carelessness or failure to comply with the provisions of this ordinance, and no Der- in:t shall be issued unless th application therefor is accompanied by a foe of $2.50 for a permit to use the streets for the dcposl of building material, and not less than $2 50 for the use of a street or stroets tor the removal of any lu-ilding: provided, that the provisions of this ord.n- ance sr.a.1 in ro manner authorize the construction or removal of a building with in the Tire hums o' l;-.e c.ty of La Grande. unless a.! the refinements establishing '.uch fire limits have bejn ful'y complied with by the applicant or applicants for such permit. Skction 6 The removal of a bunding or building under a permit, when commenced shall be continuous during all the hours of the day, and day by day. Sunday excepted, until completed, with the least possible obstruction to the thoroughfares occupied. Lighted lanterns shall be kept in a con spicuous place at each end of such build ings during the hours in which the street lamps are lighted or required to be lighted. Section 6 Upon the expiration of the time named in the permit or as near the use of the street or streets are no longer necessary, the street or streets shall be cleared of all obstructions by the holder of such permit, and placed in as good repair by such hoider as when such per mit was granted. Section 7 Any person or parsons vio lating any of the provisions of this ordin ance, upon conviction thereof before the City Recorder shall be punished by a fine not less than $5 nor more than $25. and each day of maintaining and continuing such violation shall be deemed a separate offense and punished accordingly. Skction 8 This ordinance shall be in full force and effect from and after, the 16th day of December. 1906, and shall be published in one issue of the La Grande Evening Observer. Passed by the Council of th city of La Grande, on the 6 day of December, 1906, by 5 members voting therefor, and no member voting against the same.
