WHY THE
GAME WAS

To the Evening Observer;
In view of the statements anoearinir
in these columns concerning football nego
tiations between La Grande and Island
City, the following facts may be of inter
est to followers of the game. .
After returning from Elgin Thusday,
Nov. 20, a rr.eetins of the Island Citv
team was held at which it was dacidad
to play at La Grande Saturday, provid
ing a game could be arranged with their
team; and the writer agreed to notify the
members of the team bv nine o'clock next
day as to whether the game was secured.
Bacon, of the La Grande team, was call
ed up at once; he didn't know whether
La Grande could play or not, but said he
would know by morning. .
Friday morning the writer, accom-

La Grande to see Bacon and found him
at his home. We asked him if La Grande
could play. He said he had "talked foot
ball to the boys the night before" but
that there was nothing doing. Their
"ground was not in shape," their team
"had not been practicing for two weeks,'
they "would have na time to advertise"
they "could'nt play." That' settled it
We went to the phone and notified our
players that La Grande was not able to
play us.
Friday evening Mr. Bacon called us up
and handed us the somewhat surprising
information that ' they had been working
hard all day, had the grounds fixed, had
the game advertised, and wanted to play."
On investigation we found that, as a re
sult of the notice sent out in the morning,
some of our players could not be had and
others would be seriously inconvenienced;
we were obliged to reply to Mr. Bacon
that we could not arrange to play.
In conclusion we will say that we re
fused to arrange a game with La Grande
Friday evening and that, for a very good
reason, several of our players could not
be rounded up in time far the same. We
will state further that no one in Island
City had any communication whatever
with "Manager Bay." The statements
appearing Friday and Saturday in this
column are false and misleading. Noth
ing is to be found in either item that could
te mistaken for the truth. 1

DEMIRRERS OVfRRUlfD
Judge Wolvertine in the United States
District Court at Portland, yesterday,
filed an opinion averruling and denying
the three demurrers filed by the defend
ants to the plaintiff's complaint in the
case of the Gocdnough Mercantile and
Stock Co. vs. the First Bank of E'gin and
Cecil Galloway, trusteeof G. W. Buck, a
bankrupt. This is an important case that
was fought through the state courts and
the Supreme Court finally held that the
state courts had no jurisdiction to hear
the case, and it was dismissed from the
state court. The plaintiff then began the
suit on the same facts in the U. S. Dis
trict Court last Spring, and the defend
ants filed three demurrers to the plain
tiff's complaint, raising sundry questions.
These demurrers were submitted last
June, but owing to the fact that Judge
Wolverton was called to hold court in
California, these demurrers were not de
cided until yesterday. The defendants
will now probably file answers. The
plaintiff was represented by Ramsey &
Oliver and the defendants by J. D. Slater
and F. S. Ivanhoe.
DIRECTORS ELECTED
The stockholders of the La Grande
Comme'cial Club Building Association
met last night for the organization's an
nual election of directors. Four of the
former directors were reelected and A. T.
Hill was elected for his first term. Tne
directors, as soon as they qualify for
office, will meet and e'ect their officers
for the ensueing year.

Dunn and A. T. Hill.
