In an at.empt to climb on a passing wagon' heavily loaded with barley, he slippad and fall under the wagon, the hind wheel passing across his neck. Without ever having uttered a cry he was dead. The driver of the wagon, did not see the boy or know anything of the accident un til his attention was attracted by the out cry of a witness who was standing near and who was first to reach the the lifeless corpse of the boy. No blame could possibly be attached to the driver, as the boy was attempting to climb onto his wagon without his know ledge. MOODY ROT CUllTY Not guilty was the verdict of the jury after being out fifteen minutes last even ing in the State case against Henry Moody o.i trial for three days on the charge of rape upon the the person of Latten Waldrona 14 year old g:rl living in Eagle Valley. The case went to the jury a little before 6 o'clock and the verdxt was soon returned in this notorious case. The peculiar laws of Oregon and this particular statute which wis passed at the instanceof B. F. Alley a former news paper man of Baker City, are blamed for such expensive operations as this. Common sense, and good judgement under common law, it is said by comp etent judges would regulate such affairs in a jiffy. Baker City Herald.
