It was after tight o'clock when the case
of State versus Frank Bmehoff was set
tled in Justic court last evening. '
The defendant has used a certain piece
of land for twelve years ae a road and
when notified to cease by the owner J.
D. McKennon he showed no sign of break-,
ing away from the habit according to the
testimony, and it was only as a last
resort that McKennon appealed totheicourl
Attorney Ashwill for the defense argued
that because he had used the thoroughfare
for that length of time he ha; acquired
a legal right. He also tried to prove that
the defendant had acted in good faith in
so duing However it took the jury but
ten minutes to decide that the defendant
was guilty of trespasing.
Attorney Ashwill fi ed a motion for
rest of judgement but no answer to the
motion has yet been made.
ARRESTED AND RELEASED
Las evening a warrant for the arrest
of Dick Ryan was sworn out and the man
in question was taken in by the police, ex
amination being set far this afternoon.
At the hour set today, the chief complain
ant Chas. Anderson withdrew his com
plaint and tne matter was dropped.
Ryan .ame into Chas. Anderson's saloon
last night and started a rough house
with dangerous weapons.. Mr. Anderson
promptly quelled the disturbance by call
ing the police.
, HE SPENT IT ALL
Night Policeman Waldroh rounded up
two noisy dru ks last night and placed
them in the city jail. After being ar
raigned in court this morning they were
fined five dollars apiece and on being

guessed he hadn't any seeing he blowed

Both were re-lodged in jail.
DOUGLAS
DEAD
Pendleton August 1 Last night at 7:50
occurred the funeral of Douglas Glenn
who was found dead at his cabin on the
Isascs ranch on McKay creek yesterday
morning his death being due to heart
failure. As he was in town last Saturday
night he must have died between Sunday
and Monday morning.
Mr. Glenn was born in Iowa in 1662
comming to Union county in the '80' s
and in tne '90 s proceeding to Pendleton
where he has since remained a resident.
Whan war declared ugsinEt Spain in 1898
Mr. Glenn enlisted in Company D. 2nd
Oregon which was made up of men from
this city and La Grande and he served
throughout the war in t.' Philippines.
WHEAT f OR MAY
Ouincy. Wash., Aug. 1 Reports from
Vulcan, on the Great Northern, about 18
miles west o here, say that thefaimers
in that vicinity are cutting their wheat
crops for hay, it is not being considered
worth the expense of threshing. The
failure is principally due the extreme
warm weather. j

Harvest operations throughout the In
land Empire are well under way. but as
yet no new grain has made it appeara ice
upon the local market, and grain dealer
express the opinion that hauling will not
commence much before the middle of
next month, although om small consign
ments are expected almost any day,
The gram which has been orought in to
be tested ha shown that there are two
distinctive grades in this year's pro-tuct.
Fall sown grain on the heavier land in
variably grade No. 1, while the spring
sown grain on the Flat and In other light
land localities falls below this and in
torn cases below the No. 2 standard.
Tne yield for the most part will be bat
ter than farmer have been expecting,
and between 1 d and 25 bushels will be
the average yield. Of course there will
be many fields where the yield will be
considerably less than this figures, but
these will be the exception and not the
rule.

Farmers generally are quit optimistic
over conditions as they now appear, and
