DECISION REVERSED

appellant against the Gold Coin Mining
Company, in an appeal from Baker county
bad his case reverted from the decision
of Judge Whit of Baker county by Judge
Moore. T.'.e suit was brought by Brown
to enjoin the company from polluting and
interfering with the flow of water in
Shirttail creek. The court entered a de
cree perpetually restraining the defend
ant from further operation of the quartz
mine until suitable provisions are mae.
The order prevent any injury to the
plaintiff irrigating ditches and to water
used by him. The plaintiff will receive
costs and disbursements in both counties.

MOTHER AND CHILD ARE
BURNED

Clovit. Cal.. July 24. Two lives were
lost in the destruction by fire last night
of the Hotel C'ovis. The dead are: Mrs.
Nester Freita and her infant i hild. The
fire started by the overturning of a lamp
by Mrs. Freitas. She then rushed from
the room enveloped in a blazi.-g night
dress. Tnough fatally burned about the
lower part of her body the still fought
wtth those who would restrain her from
re-entering the blazing structure to save
her baby. Finally she fell unconscious
and died this morning. Her husband : it
crazed with grief and is constantly watched
to prevent him from injuring himself. The
hotel and two residences were destroyed
at a loss of $3000 to the hotel alone. The
body of tha child was recovered this
morning.

The convention will last three days. To
day will be devoted principally to the
