the Western roads met here today to
discuss and consider the new rate bill
A means of preventing damage to rail
road interests will be thoroughly consid
ered, and a committee of railroad attor
neys has been appointed to canvass the
situation.

man Day celebration under the auspices
of the German-American Alliance is
being held here today. This forenoon
there was a big parade of the German
turner and singing societies and this aft
ernoon a big Volksfost is being held, with

New York July 16 Arrangements are
being made for the cruise of the 1st
Battalion of New York Naval Militia
during the week from July 22 to July 29
The 2nd Batta'.ion of the same organiz
ation will be taken on its annual cruise
in the week of August 1 1 to the 18. It
has nor, yet been decided which of the
several available cruisers will be used
for the New York Naval Militia. The
choice is between the West Virginia the
Maryland, the Missouri, the Illinois and
the Alabama. These vessels are now at
the Navy Yard undergoing repairs pre
liminary to joining the Alantic fleet lor
the sunimar operations off the New En
gland coast. They will be used as it
becomes convenient to draw them from
the navy yards suspending for the time
the repair work which is not sufficiently
urgent in any case to require the un
interrupted presence of the ships at the
njf jraiut.. it is iiiLenaea by the (Navy
Department to make the ' cruises of the
naval militia this summer as practical as
possible and to give the men a thprough
training within the limit of the cruise to
the end that they may understand what
would be required of them if cal'ed into
naval service in time of war. '

Trinida Colo., July 16 Passenger train
number seven of the Colorado and South
ern, catrying a hundred Elks enrouta to
Denver, was wrecked today near Korbes
Junction. Engineer Martin Cullom was
killed, and but for the fact that the train
was running slow scores of people would
have lost their lives.

FRAUD TRIAL
The Sunday Portland Journal in speak
ing of the land fraud cases now on trial
says:
Assistant Attorney-General Francis J
Heney and United States District Attorney
William C. Bristol are ready for the long
series of land fraud prosecutions. The
first of the pending cases is set Tor trial

Nickel). Henry W. Miller. Frank E. Kin
cart and Martin G. Hoge are expected to
appear before Distric' Judge Hunt with a
small army of lawyers prepared for a
hard fight.
Of the quartet about to go to trial Nick
el! is the most prominent. He was form
erly a United States commissioner. He
is a newspaper editor, and publishes two
papers, the Southern Oregonian at Med
ford and the Times of Jacksonville. Hoge
is an attorney, and Miller and Kincart are
known to the government as industriou
timber cruisers.
CHARGE IS CONSPIRACY
The charge made in the indictment
which was returned January 31, 1905. is
conspiracy in connection with the filing o'
applications. under the timber and stone
act for lands in Southern Oregon, the ex
act location being township 40 south,
range 3 west.
Much interesting testimon ' is expected.
According to the information in the hand
of the goverrment, Nickell and Hoge did
the inside work, while Kincart and Miller
kept Cruising around until they had in
duced a hundied persons to make applica
tions for land. For every one of these
applications the cruisers got $25 for in
formation furnished the victim, while
Nickell pulled down $7.60 for publishing
each notice of location. To help the
game along, Nickell occasionally printed
alluring articles in his newspapers. These
articles told of great opportunities to ob
tain land. Unce a reader interest was
aroused the cruisers took him in tow.
NEVER MISSED A TRICK
It is said that Miller and Kincart never
missed a . trick. Milliners, dressmakert
farmers, laborers, woodchoppers and men
of a dozen other callings are included ir
their list. It is even alleged that they
once invaded a campmeeling, and after
the services were over talks J land to the
worshipers until half of them agreed to
put up $25 each for information as U.

send out agents and buy out the claimants
giving them a price that would net then
a handsome return for their trouble
Trounle came before the expected trans
fers, and now the transactions are to be
aired in court. How Nickell andhisasso
ciates are to be connected with a con
spiracy to defraud the government out of
land is one of the secrets of the prosecu

The jury panel for the land fraud castii
has alr.eady been drawn, and 65 tales
men are expected in court tomorrow
morning. At the request of Assistant
Attorney-General Heney, the names were
not given out. This plan was adopted to
pn vent friends of indicted persons from
calling on prospective jurors and sounding
them before they appear in court

from Honduras dated at Salvador to-day
say nothing of the fighting ar.d merrily

Honduras has promised to stop fighting
as soon as Gautemla withdraws the troops

nventior. of the Union M ne Wjrkers of
ha First Diitrict, comprising Luzerne and
Lackawanna counties, opened hare today
with a large attendance of delegates.
The convention will probably last through
the week, as there are many important
matters to be considered. It is believed
that the present district officer will be
re-elected. Tomorrow the delegates will
take a trip to Lake Lodore. There will
be a large meeting which will be address"

Ashland. Wisconsin, July 16. Three
men were killed and-iwenty injured today
in an explosion of the plant at the dyna
mite mill in this city. J. Pierce, Supt
William Wallace and George Woods are
the dead. The damage will reach many
thousands.
..Later reports say that five are dead. as
Ralph Pringle and Ed Nolan have been
added to the death list. ' It is expected
chat many of the injured will die. The
cause is unknown. Besdes the plant'
destruction there are eighteen buildings
almost blown away.
