offense. What the difference would be
as to the vicious effects of the intoxi
cantwhether sold by an apothecary or
a drinking shop the mayor doee not dis-
e Tit. And why a druggist should be
exempted from Ikense any more than
other dealers does not appear. The
effect of Judge Eakin's decision last week
in the circuit court in case of City vs
Forbes is that druggist who 'sells in
toxicants in less quantities than one gal
lon at a time without license even "if
sold for medicial purposes, is guilty and
subject to punishment So that under
the statute and present ordinance no ex
emption is permitted in the sales . of in
toxicating liquors without license. Of
course, the compounding of liquor in a
prescription with other drugs is not
construed as a prohibitive sale. The
new ordinance regulates the sale of
liquor by druggists licenses them and
prohibits sale without. A druggist is not
mentioned in the State license law only
in local option, so that whan the country
goee dry he may sell on prescription
only. And why should $300 be exces
sive as a fine for druggists when the
present law imposes a fine of $400 as to
all persons so offending.' What court
ever declared said law-unconstitutional?
The mayor thinks with evif heart that
were I in his place 1 might yield to

as ho has. I nevecmade any pledges, and
had I been as susceptible as he, I could
have been District ' Attorney of seven
counties in 1902, for all 1 had to do was
to fall down and worship the liquor in
fluence then controlling politics, and car
rying the whiskey vote been elected; but
publicly announced that I would not
perjure myself by taking an official oath
and then let the guilty escape, hence the
resu't was not a saloon-keeper of either
party voted for me.
Again when I was mayor publie senti
ment prohibited fii conviction of any for
gambling; a jury eaw no more harm in
that crime than does the present mayor.
But people are changing for the better,
and first conviction in Union County had for
gambling was less than four years, ago.
While 1 am trying to keep pace with the
possibility of law the present official don't
progress at all, but stands for the criminal
class as shown by his veto of an ordinance
drawn for their effective punishment.
The mayor now virtuously promises to
fulfill" the duties of hie office to the
best of hie "abillity". Lets see if he is in
earnest Sec. 2895 of the laws govern
ing municipal corporations provides:
Every officer of the City or town before
entering upon the duties of his office shall
take and file with the recorder an oath to
honestly and faithfully discharge the duties
of his said office and he will support the
laws and constitution of this State and of
the United. States to the best of his ability.
By our charter it is the duty of the
mayor ' see that the- laws : and
ordinances are enforced, and he has
general eupervision over the affairs
of the City. Why then is it necessary to
make pledgee to the same effect? And
what right has he to make pledges to the
contrary? But does the present mayor
comply with.his oath? Section I960 of the
laws for the suppre ssion of gambling says
It sail be the especial duty of each sher-
ff, constable, city or town marshal and
police officer to inform against and dili
gently prosecute any and all persons
whom he shall have reasonable cause to
believe guilty of a violation of the provieion
of this act If he sees them gambling or
can see them committing this offense he
has reason to believe they are doing it
Section 1961 of the same gambling Act
provides: "Any officer named in the pre-)
ceding eection who shall refuse or will
fully neglect to inform against and prose
cute offenders against this act shall, be
deemed guilty of a misdemeanor and on
conviction shall be punished by a fine of
not less than fifty nor more than five
hundred dollars, and the court before
which, such officer shall be tried ehall de
clare his office or appointment held by
s-ch officer vacant for the balance of his
term."
If the mayor is so technically honest
and faithful and zealous as he boas-.swhy
don't he "see that the laws are obeyed?
and in hie supervision of the city affairs
and its junior officers see that they per
form their duties? No wonder the people
are going to the local option law for re'
dress by wiping out the saloons alto
gather. And it is useless for the mayor
to deny "that he is pledged to the ' sport
ing or saloon element" accuse every one
who thinke so as a knave and demand the
proof since it is an axium of our code
Uat every one is presumed to intend the
orJinary consequences of hie voluntary
acta and conduct. The veto of an ordi
nance designed for and capable of pre
venting, as well as punishing crime, and
bis reasons given for its veto require no
