The Miller Case
. District Attorney Lomax, aeaisted by
Mr Smith, ?.hea merged victor In the
fierce legal contest which hs been
waged erer alnoe Boy Miller went oo
trial and tbla afternoon the state will
complete Its evidence. 8trong points
of la bar arisen which ware ably
urged by C A Johns, attorney (or the
defendant, regarding the introduction
of certain evidence. The case Is being
stubbornly fought on both aldea and
every opportunity la taken advantage
of. But the state has prevailed and
nearly all the evidence on hand Intro
duced. Tomorrow morning It - la expected
the defense will be given their Inning
and the testl atony will be beard with
mora than ordinary interest. The court
room today was crowded wit-i specta
tors. Mr Johns contested every point
rslsed in fsvor of the defendant and
able legal arguments were numerous.
The time today was taken np by the
ttate In the introduction of evidence
tending to show that the $15,000 check
given Goes as alleged I the indictment,
bad been cleared thro :fc the Bank of
Sump tor, marked paid and placed on
the books as cash, when in fact it was
never paid at all and was worthless.
This Is the contention of the state. H
8 Darg in, who was cashier of the Bank
of Sumpter, wss the principal witness
this morning lie identified several
deposit checks made by the bank In
favor of A P Goss, the state holding
that these checks were only a cloak to
cover op the crooke I transaction and
that the money noted on them was
never in the bank.
Just what the defense will be is not
known, but it Is promised to be strong.
Mr Johns Is fighting the caie on every
ground and appears oon&dent of clear
ing his client. Baker City Gerald.
