the complaint of the California Com
tnercial association, composed of 89
mercantile firms in this city, charging
the Velln-Faruo Kxpre company with
concealing from the public tariff chd
ules that had been Hied with the Inter
state Commerce commisaion in Wash
ington and with making unjust and dia
criminatory rates. The actual question
Involved, however, waa whethet or not
the quantity rate ct 8 cents a pound
from New York to San Francisco for
shipments of 10,000 to 20,000 pounds
applied to bulk or assembled ship
ments, gathered and forwaided by a
forwarding agency to one concern or
association organised fot the pnrpoae of
getting the lower mte, the shipment
ultimately intended lor numerous con
signees who were designated by num
ber of the labels to the one consignee.
The chargsa of discrimination are
based upon the refusal ot the express
oouipany to transport a shipment of
16,000 pounds consisting of 443 pack
age, from New tork to the la It torn la
Commercial association in Hau Fran
cisco last August, at the bulk or quau
tity rate of f 8 per hundred pounds, the
company charging the regular package
rate. It is also alleged that the ex
press company charged a higher rale
than that published and filed with the
