try William 0. Haywood for his life on
the charge that he murdered ex-Governor
Frank Steunenbej have been
chore and bound by oath to honestly

prisoner. Haywood ha beard the in
dictment charging him with the crime
and today, after the state has recited
it ease and wade promise of proof, the
first chapter of the sickening tale of
the Caldwell crime will be retold.
The wearisome work of jury selec
tion ended quickly and, unexpectedly
Monday morning.
The court room hushed to silence a
the 13 men rose in their places and,
facing th clerk's desk on th left,
raised their right hands in solemn
asseveration of their pledge to do exact
justice by the accused. It wss aa im
pressive scene and there came another
two hours later, when after the mid
day recess Haywood listened to the
reading of the indictment against him
self, Mover, Pettibone and bimpkin.
liavwood had come to the court room
whitened somewhat in color from bis
ill n en of Saturday, but as the clerk
walked in front of the jury box and
began reading the indictment a little
tide of blood came up along his neck
and spread over hi cheeks. His wife
and daughters sat at his side during
the brief afternoon session at which the
indictment was read. Haywood talked
with them and hi counsel after the
statement was read and then, aa he rose
to return to his cell, smiled a friendly
greeting at a friend sitting near the
end of the bench.

Accused of Trying; to Subvert Law by
Seeing Prospective Juror.
San Francisco, June 4. The grand
jury late-last evening filed with His
trict Attorney Langdon a formal com
plaint against Chief of Police Jeremiah
r. Uinan, charging him with wiliul and
corrupt misconduct in office in that he
subverted the law in endeavoring to
secure the acquittal of a defendant
without the knowledge of th District
Attorney. The defendant in the ease
was Mayor Schniitx and the investiga
tion by the grand jury grew out of the
accusation of Assistant District Attor
ney Francis J. Heney that Hinan had
attempted to tamper with the tales
men drawn for the jury which is to try
the Msyor on a charge of extortion.
Pinan was accused by Mr. Heney of
having detailed some of hi officer to
interview prospective jurors in the in
terest of Schmitz. The chief practi
cally admitted having detailed men to
hadow some of the men on., the venire,
but declared that he did so because he
wanted to see that no improper person
got on the jury.
STRIKE CALLED OFF,
Delegates of French Seamen Advise
Men to Return to Work.
Paris, June 4. The extended strike
of the seamen has virtnalaly come to
an end, with the capitulation of the
strikers, who are expected to resume
work at the home and colonial point
immediately. Captain Lapere, one of
the strikers' delegates, conveyed the
lniormation to Minister ot Marine
Thomson st a late hour last night. He
informed M. Thomson that the strike
committee assembled in Paris had tele
graphed the following message to all
ports:
"The delegates have been in confer
enee with the Minister of Marine and
the naval committee of the Chamber
of Deputies. The Minister ha aban
doned the prosecution of deserter, and
he ha requested tne navigation com
panies to reinstate all the officer and
men. The members of the naval com
mittee assured the delegates that M.
Thomson's proposition in the matter of
pensions would be improved. The dele
gates, therefore, immediately proposed
that the strike cease."

San Antonjo, Texas, June 4. One
man was instantly killed and a score
of person injured, some of them
fatally, by the wrecking of east-bound
passenger train No. 8 two miles west
of Lozier, a small station on the South
ern Pacific. The derailment was the re
sult either of train-wreckers or defec
tive steel, though the positive eause ha
not been determined. The train wa
dashing along at a speed of from 35 to
45 miles an hour when the derailment
occurred. Every ear on the train was
derailed, two of them turning over.

San Jose, Cal., June 4. An attempt
to wreck the early morning train be
tween this city and San Francisco was
thwarted yesterday by the fortunate
discovery, shortly before S o'clock, of a
large pile of ties on the Southern Pa
cific track, at a point near Santa
Clara. Also a rail bad been loosened,
and had not the discovery been made
just in time, a frightful wreck almost
certainly would have resulted. Officers
are busy in an attempt to run down the
criminal and two arrest bave been
made, the men in enatody being tramp.
Beef Goes Up In Chicago.
Chicago, June 4. Higher prices for
all grade of beef are in prospect, and
steaks and roasts are to eost the con
sumer more money. The enforcement
of the rule by the big Chicago packers
that incoming cows and heifer must
be sold to them only subject to post
mortem examination is causing the trou
ble, and the deadlock which has been
in foree between the commission men
and the packer during the past week
promises to hold on indefinitely.

found the Watera-l'ierr Oil Company
of Missouri guilty ol violating tu ami

new trial and the ease will be taken to
