Editor Mist. It has been a long time
ainno we saw any items in Til Mist from
this place, and if you will allow us a por
tion of your space we will attempt to send
you a few Items occasionally, especially
those Items that will prove of interest to
the uowa-loving public. It should be the
aim of the local paper to publish the local
news, but ih the Vernonia paper puts all its
anergics into politics, we Nehalemites wilt
J..ive to took elsewhere for the local news,

local paper, we conclude to send our locals
to St. Helens to be published. They may
be a few hours late by the time they tret
back here, but nevertheless the people will
hear of them.
At this writing there are about six
incites of snow ut tint poiut. Last

more of the) beautiful, but the recent
rains reduced that depth, mid the
jiroepecl now is that the earth will be
black as ever within a few days, tiuless

law delegating powers to the comity court, it
will be sees the county court has no power
make anybody comply with the law, and
power to Indict anyone or try anyone for an of
fense or violation of law, hut who has? IM the
law answer. Section 973 ol Hill's Annotated
Laws of Oregon says: "The district attorney
each dtstrtct is the public prosecutor therein.
Section 97 says; "He shall attend the terms ol
all courts having Jurisdiction of public offenses
within his district, aud conduct on behalt of the
state all prosecutions for such offenses therein.
Section liM says: "The district attorney may
submit an Indictment to the grand Jury in any
case when he has good reason to believe that
crime has been committed which is triable
within the county." (Section 12AS says: "The
district attorney, when required by the grand
Jury, most prepare indictments or presentments
for them in relation to their duties, etc'
It will be seen from the above law that the
district attorney is the man and only man who
has control of the whole affair. Now let as see
II the grand Jury had anything to do in the mat
ten under the law. Section 13(2 of Hilt's An
notatad Laws of Oregon says: "The grand tury

plied for patent on an appliance for
safely hitching horses and cattle. It
is a good arrangement and agents will
be working all over the county in a

manufactured in Vernonia. A mod

our people are living as well today as

rond rumors create no excitement, and
everybody in happy. -

Section 1251 says: " In addition to the power
and duty prescribed by section 1242, the grand
jury has power and it is their duty to inquire,
1st, into the condition and management of every
public prison in the county, and 2nd, into the
condition and management of the offices per
taining to tbe courts of justice In the county.1
Thus it will be seen that the district attorney
and the grand juries ot Columbia county are
alone and solely responsible lor the sheriffs not
settling as required by law. They alone had the
right authority and duty to enforce the law, and
we can safely aay that if they had dona their
duty we would have na defaulting ex-sheriffs in
our county. We are sorry they did not hare
the courage to acknowledge their fault, but the
people ol Columbia county are not idiots nor
fool and will not be deceived by their attempt to
shirk the burden they should bear, but in the
minds of the people the burden will rest where
it legally and rightfully belongs. As to our lees.
oar bills are on file and can be examined, and
if any one questions them as being too high or
improper, we are willing to have them pub
lished and show what they are for and let the
people Investigate for themselves. Knowing
that we have not charged as much mileage lor
coming from tbe same place to St. Helens as one
of the last grand jurymen did, and that our bills
are all regular, legal, and correct.

ney and tbe misrepresentations of the grand
Jury iu their report at the adjourned October
term of circuit court, MM;
It is with a feeling of deep regret that we en
ter into any controversy, or attempt to criticize
the actions of anyone, h i! the district attorney,

October term of the circuit court, 1893, so far
forget their duties and legitimate powers, or
were ignorant ol them , that they make use ol
their prortnee to males a report to the circuit
jj tgeaiitl to abuse the county court and mis
represent the comity commissioners. Not sat
isfied with that they go further, and, by impll
ration, mis-epreseat the law and attempt to
shirk the duties which the law imposes on Die
Xietrlt-t attorney and grand Jury and, by mis
representation, saddle them on the eonnty court.
while in fact and iu lac the county court could
not do what they say it should have done, but
a the contrary It is the auty of the district at
torney aad grand Jury to do what they say the
rouaty court should have done, ss we will show
by quoting the law of the State ol Oregon.
we lesl that we are driven to this in de
fense ol ourselves; our character, our honor,
and our Integrity, as the report of tha grand
Jury is a public record standing against us and
has been published in our local papers showing
all the people the charges made against us. U
we do not refute these false charges aud resent
the insult It may be considered that we ate to
blame as ebarged, and we know of no other
Way to set ourselves aright than to explain the
matter as it is, to the people, hence this article.
The grand Jury, in its report, says: "We, since
ISM, have had a statute in this state requiring
trie sheriff to pay over all money collected on

county, once a month, taking duplicate receipts.

If this statute had beeu enforced by the county
oourt. in our opinion there would be no short

this county has been derelict in their duty In
not requiring the sheriff to pay over, the tax
money collected and file their receipts there

Last Saturday we seen C. W, Maysrer do
some of liis fastest running, und we will put
him up for the fastest runner on record if
ha could keep hit legs from lapping around
each other.
The supervisor here has tilled the bad
places in the roads with dirt and the mild
is about two feet deen there now, which
makes the road simply impassible. Will
the people never learn that gravel or crushed
rock is tha only remedy for bad roads.
Col. Kellnru will beach his scow tor the
winter in few days.
Master Fred and Miss Eva Mayjter left
here Sunday for Clatskanie, where they
will attend school this winter.
