I). 1914, along the route and to thew idth therein mentioned, and o have then and there ascertained, fixed and determined the amount of bimaite sustained by nnd to be paid to each of said owners, lessees and nciimbraiicers for the appropriation of lands and premises necessary for he establishment, widening, straightening and changing and improve ment of auid portions of said road between tho terminal points aforesaid, nd thut aald notice further notified each and all of said parties that If hey failed to appear to show cause, this Court would by order and resolu lon establish suld widened, straightened and changed portions of said oa.l as the main County Highway of such County and order the same open d and Improved, and would then and there ascertain and determine the mount of damages Buatnined by them and each of them, by reason of the impropriation of the lands and premises for the establishment of such wld 11 ed, strultthtened and changed portions of such road, and direct the pay ment of such sum to each of said parties, accordingly as by law prescribed. The said notices so Issued and served as herein found are each hereby re orred to and made a part thereof, together with tho certificate of service .hereof and atll.luvlt of the posting are hereby made a part of this order. The Court further finds that each and every person, owner, lessee and Incumbrancer of Innds, tenements or appurtenances which are in anywise iffected by the widening, straightening and changing of said road, and each nd every person owning lands appropriated therefor, have been duly and I'ogulnrly served within tills County with such notice of the hearing hereon, la required by law, more than twenty (20) days prior to the 20th day of August, A. D. 1914, and that all notices required to be published have been duly and regularly published and posted, aa required by law, and ac cordingly as hereinbefore determined, and that the persons above mention ed and served with such notlo are the only persona affected by the widening, itraightenlng nnd changing ot said rond, all other persons having hereto fore granted to Columbia County a right of way for said road throughout nts entire longth, accordingly as hereinbefore described. Nlck erson, School District No. 61, G. W. Parker, 8. A. Bheolf.v, H. A. Wilson Nehalem Investment Company, Fir Tree Lumber Company, DuBola Lum ber Company, Western Timber Company, Detroit Trust Company, Appledale Land Company, J. T. Adams, Bernard Royer, and F. E. & BeBsle Malmsten Whereupon, the said Court caused the said report of aald surveyor to be publicly read, and after considering same and protests filed against the establishment thereof, and after hearing all testimony and documentary evidence offered for and against the establishment of said road, and after being fully advised ln the premises, finds that such road will be of public utility and convlence to Individuals and the public, it Is hereby ordered that the said protests be overruled and denied, and that the said road so widened, straightened and changed is hereby declared to b a public highway and the same Is hereby ordered and directed to be opened and improved' and the County Surveyor is hereby directed to make a final survey and loca tion of said road on the lines hereinbefore directed, and deposit said report with the Clerk of this Court, and said surveyor is hereby required and directed to deposit with the County Clerk of this County a complete set of field notes of said surveyed line of said road, showing the ties of govern ment corners along the route, the location and witnesses to the mile posts, and the beginning and termination points of said road, together with a plat showing the alignment of the proposed road, which plat shall show the points and locations of all the mile posts and ties to the government cor ners where obtainable, and the location and approximate size of all creeks, rivers, swamps and other natural features that may be important, the loca tion of all culverts, box drains, bridges, tide boxes and all highway, rail road and other crossings, the amount of excavation and embankments, and an estimate of the total costs of construction, together with any other in formation and details that may be useful ln connection with the Improve ment of Bald road. The Court thereupon took under consideration the amount of damages to be paid to the owners, lessees, incumbrancers, and parties interested In the lands appropriated by, or ln any manner affected by the establishment of said widened, straightened and changed road, and after listening to all evidence offered on the part of the respective parties claiming damages, ind not being fully advised ln the matter, reserves its decision for further consideration. On this day this matter coming on regularly for hearing upon the ob 'ections and remonstrances of the Northern Pacific Railway Company and of the Spokane, Portland and Seattle Railway Company, all parties being nresent, and the Court not being fully advised ln the matter, It Is ordered by the Court that this matter be, and the same Is hereby continued until Wednesday, September 2, 1814. In the matter of Sealed Proposals for constructing a portinon of the Ne halem Highway, between Mist and the' Washington County line. On this 28th day of August, 1814, it appearing to the Court that hereto fore, on the 22nd day of August, 1914, this matter came on regularly for consideration and bids for saidr oad construction, according to the plans nnd specifications on file, were opened and examined by the Court, being as follows, Elliott Contracting Company, Miles 1 and 2. A. R. Mells, Mile 3 and L. A. Peterson, Mile 4. And the Court having taken the same under advisement, now, on this day, the Court being fully advised in the matter, it is ordered by the Court that all of said bids be, and the same are hereby accepted. It is further ordered by the Court that contracts be entered into with said respective bidders, for the faithful performance of the same. Whereupon, Court adjourned.
