quired to appear and answer the com
plaint filed against you in the above
entitled court and cause, on or before
the expiration of six weeks from the
first publication of this summons, to
wit, on or before the 16th day of May,
1914, and if you fail so to answer the
complaint the plaintiff will apply lo
the said court for the relief demanded
in the complaint. The relief demanded
in the complaint is the condemnation
and appropriation under the law of em
inent domain of a railroad right of way
sixty feet in width over and across the
southwest quarter of the northwest
quarter and lots four, 4, and five, 5, of
section five, 6, in township seven, 7,
north, range five, 5, west of the Will
amette Meridian, in Columbia county,
Oregon, such right of way to extend
along the southerly bank of Westport
Slough from the western boundary of
the said premises to the southern
boundary of the said premises, and to
be bounded on the northerly side oy low
water mark of Westport Slough and on
the southerly side by a line parallel
with said line and sixty feet distant
therefrom; also the condemnation and
appropriation of the right to go upon
the southerly bank of Westport Slough
along and throughout the northerly line
of said premises and build, maintain
and use rollways, piling, booms and
such other structures or appliances as
may be necessary for, and to use the
said bank for all purposes in or about,
the dumping of logs from the cars on
the plaintiff's railroad into the waters

of Westport Slough. and rafting, boom
ing and handling such logs.
Thii summons is published once each
week for six successive weeks by order
of Hon. W A Harris. County Judge
Columbia County, Oregon, made and
entered the 1st day of April. 1914. and
the date ot the first publication thereof

To A. H. Scott and Jane Do Scott,
his wife, above named defendants;
In the name of the State of Oregon
yon are hereby required to appear and
answer the compaint filed against you
in the above entitled suit on or before
the 16th day of May. 1914, and if you
fail so to appear, and answer, plaintiff
will apply to the court for the relief
prayed for in said complaint, to-wit:
A decree that said defendants shall
on or before a day certain to be fixed
by said court pay in cash to this de
fendant the following sums, to-wit:
Four hundred and seventy five dollars,
1475.00, the balance due on account of
the purchase price under one certain
contract of sale of Tract No. fifty, 50,
Scappoose Acre Tracts, dated October
19th, 1912,with interest thereon at the
rate of 6 per centum per annum from
the 20th day ot December, 1912, and
the further sum of four and 16-100
dollars the same being the amount of
the taxes paid by plaintiff on behalf of
defendants under the terms of said con
tract, that the plaintiff on the receipt
of said money so to be paid aforesaid
to execute and deliver to defendants a
good and sufficient deed of bargain and
sale, conveying said Tract No. 50,
Scappoose Acres to the said A. II.
Scott in accordance with the terms of
said contract above mentioned.
And a further decree that if said
defendants fail to pay to plaintiff said
sums of money within the time speci
fied and stated aforesaid that it be de
creed that said defendants be barred
and for ever foreclosed of all right,
title and interest in and to said proper
ty, Tract No. 60, Scappoose Acre
Trscts, and each and every part there
of, and that said defendant be further
declared to have forfeited all their
right in and to said sums of money
heretofore paid to plaintiff on said con
tract, and for plaintiff's costs and dis
bursements herein, and for auch other
and further relief as to the court may
seem just snd proper.
Service of this summons is made up
on you by publication in pursuance to
an order of thell on. County Judge for
Columbia County, made on the 27th
day of March, 1914, directing such
publication in the St. Helens Mist once
a week for six consecutive weeks, the
first publication being made April 3,
1914.
