Ordinance No. 162
An ordinance to enable the Common
Council of the City of St. Helen, Ore
gon, to require the owners of any lot,
parcel or block of land in aid city to
construct and maintain, at the cost and
expense of such owners, sidewalks
abutting upon such lot. parcel or block
of land,. The City of St. Heelna does
ordain as follows:
Section 1 The Common Council of
the City of St. Helens, is hereby au
thorized and empowered to require by
ordinance the owner or owners of any
lot, parcel or block of land in said city,
to eonsturct or build a sidewalk abutt
ing such lot, parcel or block of land,
at the expense of the owner or owners
thereof, and to maintain the same in
gutxl repair.
Section 2. Should any property
holder for a period of thirty days after
the final passage and approval of said
ordinance neglect or refuse to build
such sidewalk or put it in proper repair
when ordered by the council to do so,
the council is hereby empowered to lay
said walk, or repair the same, and to
assess the cost thereof against the
abutting real property, by ordinance.
Section 3. As soon as such asess
ment has been made the recorder of
said city shall enter in a docket kept
for that purpose by name or number,
a description of each lot or parcel of
lad against which such assessment is
made, with the name of the owner or
owr.ers, and the amount of the unpaid
assessment. Such dcoket shall stand
thereafter as a lien docket as for taxes
assessed and levied in favor of said
city, und for the amounts of such un
paid assessments therein docketed, with
interest on said unpaid assessments at
the rate of 6 per cent per annum
against such lot or parcel of land, until
such assessments and interest shall be
paid; and all such assessments and
interest shall be and remain a lien on
such lot or parcel of land in favor of
said city, and have priority over all
other liens and incumbrances whatever.
Section 4. Whenever any payment
of such assessment, together with the
interest thereon shall be made, the re
corder of said city shall make an entry
thereof in said lien docket, with the
diite of the same; and such payments
shall operate as a dischrageof said lien
to the amount of such payment and
from the date thereof. Rut should such
owner or owners neglect or refuse to
pay the sum or sums aforesaid for the
period of thirty days from the final pas
sive of the ordinance levying such as
sessment the same shall be deemed de
linquent, and the Common Council of
i-aid city may thereafter order a war
rant for the collecton of the same to
bo issued by the recorder and directed
to the marshal of said city.
Section 5. Such warrant shall re
quire the city marshal to proceed to
collect the unpaid assessments named
therein by advertising and selling to
th highest bidder the lots, parts there
of or tracts of land described in such
warrant in the manner provided by the
law of Oregon for the sale of real es
tate upon an execution, at the front
door of the City Hall in said city,
and said marshal thall return the pro
ceeds of such sale to the city treasurer,
and the warrant to the city recorder,
with the his doings endorsed thereon,
together with the receipt of the treas
urer for such collection.
Section 6. All the sales of real
property for the non-payment of any
sidewalk assessment, shall be made
at the front door of the city Hall of
said city; and notice of such sale may
be given through any newspaper of

general circulation in the city, and said
city for want of other bidders at such
sale or sales may become purchaser
thereat.
Section 7 At any such sale said
lands shall be sold subject to redemption
as provided for under the sale of land
upon execution, except that all certi
ficates of sale shall be issued by the
marshal, all redemptions made by him
and all deeds executed by him; and pro
vided, also that any person having an
interest in said land such as would en
title him to redeem real property sold
on execution shall be allowed to redeem
the same from the marshal at any time
prior to the execution of a deed to the
purchaser upon the payment of the
amount bid at such sale, with interest
at the rate of six per cent per annum
thereon to the date ot redemption, to
gether with all taxes paid thereon by
such purchaser, with like interest; and
any deed provided for shall be made at
or after the expiration of the time pro
vided by law regulating the making of
deeds for property sold upon execution.
Section . If the payment for any
such construction, repair, or improve
ment of any siedwalk shall become due
under the provision of any contract for
the same, prior to the collection of any
or all amounts so assessed, the city of
St Helens shall pay the same by war
rant drawn on the general fund of said
city, and thereafter turn into the city
treasury any and all amounts so col
lected on such deliquent claims, over
and above the costs of collection.
Section 9. That all ordinances and
parts of ordinance in conflict herewith,
and especially ordinance No. 85, be
and the same are hereby repealed.
