Matter of petition for incorpor
ation of Scappoose, Oregon.
On th;8 day this matter coming
on for consideration upon the re
turn of the election held on the
:10th day of August, 1913, and it
appearing to the court from the
canvass of said return of said elec
tion that the total number of votes
cant at said election was 140, of
which r.umber Gl were cast for in
corporation and 79 were cast against
incorporaMon.it is ordered by the
court that the town of Scappoose is
not incorporated.
Matter of petition of Jno. M.
F.isenblatter for road easement.
On this day the report of the
board of county road viewers on
the John M. Kisenblatter road of
easement was read in open court
the first time.
Matter of deeds from E. M.
Watts et al for a county road:
On this 3rd day of September,
1913, this matter coming on for
consideration upon the report of
the board of county road viewers,
together with a plat of the said
road in accordance with said deeds
as duly executed by E. M. Watts,
0. 0. Klapp and J. B. Duncan et
ux., said report being favorable
and no remonstrance or other ob
jection being filed or made herein,
it is ordered by the court that the
said report be accepted and that
said deeds and plat be recorded in
the manner provided by law, and
from thenceforth said road shall be
a public highway.
It is further ordered by the court
that the road supervisor in whose
district said road is located, shall
open the same for public travel.
Matter of petition of 0. I). Kyle
et al for permission to erect tele
phone line in county road:
On this day comes on for hearing
the petition of O, D. Kyle et al for
pei mission to erect and maintain a
telephone line on the county road
between St. Helens and Trenholm,
an3 the court being advised in the
matter, it is ordered by the court
that said petition be allowed on the
condition that said line shall be so
constructed ami maintained as not
to in any manner interfere with the
public travel or improvement of
said road.
Matter of sculp bounty cims:
On this day the cierk presents to
the court a statement of scalp
bounty claims, showing the number
and amount of warrants drawn bv
him and the names of persons to
whom issued and the date and num
ber of each warrant, being as fol
lows: Claim No. C5, Robt Hamill,
$1.50 for one coyote, warrant No.
173, dated August 16th, 1913.
Matter of application of Louisa
B. Uice for widow's pension.
On this 3rd day of September,
1913, there is presented to the court
an order of the juvenile court of
this county, allowing widow's pen
sion in the sum of $17.50 per month
in favor of Louisa B. Rice, in ac
cordance with Chapter 42, S. L
11)13. And the court being ad
vised in the matter, it is ordered
by the court that the clerk be nd
he is hereby instructed to issue a
general fund warrant in the sum of
$17.50 in favor of said Louisa B,
Uice, and a like warrant on the
first day of each month hereafter
until the further order of this court.
Matter of bridge across Beaver
Creek on the I. D. Wonderly road
On this day this matter coming
on for settlement of contract with
Portland Bridge & Iron Company,
and it appearing to the court that
the original contract price was the
sumof$lG:w, that 5 1-2 yards of j
extra concrete were used, at $12
per yard, as per agreement, amount
ing to $00, and that the sum of
$.100 has been heretofore paid on
said contract, it is ordered by the
court that the clerk be and he is
hereby instructed to issue a war
rant on the general road fund in
the sum of $1204 in favor of said
Portland Bridge & Iron Company
in full settlement of said contract
for said bridge.
Matter of resignanion of county
sealer of weights and measures:
On this day Geo W. Brnes pre
sents to the court his written resig
nation as county sealer of weights
and measures and the court being
advised in the matter it is ordered
by the court that said resignation
be and the same is hereby accepted.
Matter of appointment of justice
of the peace for Clatskanie pre
cinct. On this day this matter coming
on for consideration upon the peti
tion for the appointment of J. M.
Blackford, containing 33 signatures,
and the petition for the appoint
ment of Geo. W. Barnes containing
162 signatures, and the court being
advised in the matter it is ordered
by the court that G.M. Barnes be and
is hereby appointed justice of the
peace in and for Clatskanie pre
cinct to fill out the unexpired por
tion of the term of J. R. Snow, de
ceased. It is further ordered by the court
that before entering upon the duties
of his said office he shall file a bond
n the sum of $1000 and take the
oath of office as prescribed by law.
Matter of petition of James El-
wood for reminsion of tax:
It appearing to the court from
the petition of James Elwood for
remission of tax: It appearing to
the court from the petition of
James Elwood and from the records
that the W 1-2 of SW 1-4 of Sec.
32, Tp 6. N R 5 W of W M was
erroneously assessed to Albert R.
Miller on line 21, page 22 of Vol. 3
of the 1907 assessment roll, when it
was intended to assess W 1-2 of SE
1-4 of Sec. 32, Tp. 6 N " R 4 W to
him and that the last described
tract was also assessed to the Ben
son Logging & Lumbering Co., to
whom said Miller has sold the same,
on line 24, page 35 of Vol. 4 of
said roll, who paid the tax thereon;
and in further appearing that title
to said W 1-2 of SE 1-4 of Sec. 32.
Tp. 6 N R 5 W was at that time in
the United States, and that Bror L.
Hendrickson to whom patent after
waJds issued therefor did not prove
up on the Bame until June 8, 1908.
It is therefore ordered by the
court that the tax, in the sum of
$1.40, so assessed on said line 21,
pafce 22. Vol. 3 of said 1907 roll be
and the same is hereby remitted,
together with penalty and interest,
and said erroneous assessment is
hereby cancelled.
Whereupon, court adjourned un
til Thursday. Sept. 4, 1913.

by mailing, had been given the
owners of the land through which
said proposed road is to be located,
and the court being satisfied that

the court that said report, survey,
profile and plat be recorded in suit
able books kept for that purpose,
