Oregon, his ' divided said city i'lto sewer districts, in accordance with the natural I topography of the several addi 'tions, blocks and lots Comprising jsaid city, of which the hereinafter U' escribed district is and shall lie known bs Sewer listiet No. 5 of said city, and in relit ion thereto has furnished such frecommenda tions, maps and iirvstfations to are needed for the giViance of tho common council of sslid city; And whereas, said district em braces a large number of inhabi tants and residents, and is utterly without any system of sewerage or drainage, and there is grave av prehensi.m of an epidemic of sick ness from the want of proper sewer facilities in Bald district and city. And whereas, it is obvious to the common council of said city and to the eitv health olhcer, that a sewer- iro niHtem is necessary for the health and convenience of the city and iU inhabitants, and especially of that portion of said city cm- i.rpi.it in said district and the resi dents thereof. Knw. therefore, the city of St. Helens does ordain as follows Section 1. That in pursuance of Chapter XI. of the Charter or the City of St. Helens, Oregon, relat ing n wu.-ers and drains, the city engineer of said city has divided tw pit into sewer districts and ho nnmliered the same consecu i.,l in necordunce with the 'natural topography of the several tn.l.litions. blocks and lots compos- l inir siiid citv. and among others has numbered and designated one as u;er district No. 6 of said city. the boundaries of which are as fol lows, to-wit: Beginning at the intersection of the center line of Wyeth strtet with that of Walla Walla street, in said city of St. Helens, and run ning thence southerly on the center line of Walla Walla street 446 feet; thence westerly and parallel with Wyeth street 800 feet to ttie cas; i;n. f n..nit street thence north- R. P. & S. railroad right of way; thence north 16 deg. 2S min. east along the east line of said right of way, 1911.3 feet to the northwest corner of Railroad Addition to St. Helens, thence south 85 deg. 59 min. east along the north line of said Railroad ad dition 424.9 feet; thence south 09 leg. 08 min east along the north line of Railroad addition, aforesaid, 356.85 feet; thence south 61 dog. 36 min. east 347.18 feet, more or less, to a westerly extension of the north line of Columbia I'ark, now a part of said city; tjenee easterly on the north line off Columbia Park aforesaid, 970 f-t to the center line of Hinlk street; thence southerly on he center line of Hemlock street, 290 feet, more or less; thence westerly at right angles to Hemlock street, l lO feet to the common corner of lots 6, 7, 16 and 17, in Mock 4 of Columbia l'ark, aforesaid; thence southerly and parallel with Hemlock street, 174 feet to the common corner of lots 3. 4. 19 and 20 in. said block 4 of Columbia I'ark; thence westerly at right angles. 140 feet to the cen ter of Walla Walla street; thence southerly on the center line of Walla Walla stieet, 214 feet to the center line of West street, in said city; thence easterly on the center line of West street. 240 feet to the west line of Hemlock street; thence southerly on tho west line of Hem lock street. 446 feet: thence westerly at right angles 100 feet; thence southerly and parallel with Hemlock street, 272 feet to the cen ter line of Wyeth street; and thence westerly on the center line of Wyeth street. 140 feet to the place of be ginning, containing 514 lots; and said sewer district shall be hence forth known as Sewer District No. 5 of said city. Section 2. It is hereby declared that a sewerage system within said tewer district is necessary for1 the health ami convenience of said city a-id its inhabitants, and especially is it necessary for the health and con venience of said sewer district No, 5 and the residents and inhabitants thereof; and it is the intention of the common council of said city to establish a sewer system therein be cause of such necessity. Section 3. That the sewer pipe will be of glazed, vitrified sewer pipe, and the sub-drain, wherever used, will be of drain tile, the size of which, together with a particu lar description of all other ma terial can be ascertained by an in spection of the specifications filed with the city recorder on May 22nd, 1913, and made a part hereof. Section 5. That W. J. Fullerton, John Q. Cage and Harold Ross are hereby appointed appraisers and arbitrators to make the appraise ment of the probable costs of said sewerage system among all the real estate owners in said district, in accordance with the provisions of the city Charter, as well as to per form such other duties as are re quired of them, thereunder. Section 6. That notice shall be given bv the city recorder for two successive weeks in a newspaper of general circulation in said city and by posting for the same length of time, in three public places in said city, definitely fixing the time and place of meeting to be held by the common council of said city for the purpose of hearing any and all com plaints by or on the part of any and all property owner'' within the limits of said district; and all per sons whose propert is so affected shall have the rigiit to appear and make and file heir objections to the location of the boundaries of the district, 0 other objections to suci impnWement; and the said council shun have the power under this ordinance to make such alter ations as it shall deem in accord ance with justice and for the best interests of said city.
