But the executive results will remain secret to everyone, in cluding the court and the ASUO Elections Board, until Monday. The court will hold a public hearing today at 6:30 p.m. in Room 243 of the William H. Knight Law Center to decide if Gabbe andvLarson broke ASUO elections rules when they spon sored a Feb. 4 International Stu dent Coffee Hour by spending about $40 on refreshments. The pair also had posters and other items promoting their campaign at the coffee hour. Elections Coordinator Ken Best and other candidates all agreed Thursday that the court’s new de cision to hold the results will help everyone involved. “It shows great foresight and ensures a fair, unbiased deci sion,” Best said. The board decided they would not look at the executive results until Monday’s court decision. But Larson said he worried the decision to hold the results might hurt campaigners preparing for the general election on March 1 and 2. “It does hurt people ... who need to campaign for the general elections,'’ he said. Larson said he and Gabbe will continue to talk to people about their campaign over the weekend but they won’t make posters for the general election until the court’s decision. But the court’s decision still presents some questions. Accord ing to the court’s decision to hold the hearing, If Gabbe and Larson place first or second in the prima ry and lose their appeal to the court, then they will be replaced by the candidate who placed third in the primary for the gener al election. Best said he worried that if the election did turn out that way, the people who voted for Gabbe and Larson would technically not have a valid vote. Justice Daniel Vegramini said he couldn’t comment on what the court will do if that happens. On Feb. 10 the ASUO Elections Board ruled they did break elec tion rules by offering a “thing of value” and promoting the out come of the election and removed Gabbe and Larson from the ballot. They appealed the decision to the court the next day. The court justices felt they couldn’t make a fair ruling until they heard from the elections board and Student Sen. Jennifer Greenough, who filed a grievance against Gabbe and Larson after they hosted the coffee hour. They set the public hearing and decided to put the pair back on the ballot until guilt could be determined. “The elections board ruling, if enforced, would effectively pun ish him before his appeal can be heard. This is not a just result nor is it in the best interests of the ASUO,” Justice Robert Raschio said in the court’s opinion. , Members of the elections board were outraged by the decision, which Best, the elections coordina tor, called “horrible.” They said they felt that by placing Gabbe and Larson back on the ballot until the hearing, the court was invalidating the board’s original decision. This year’s election was the first to be conducted entirely via computer on Duck Web. Because of a program error, some graduate and law students were not able to vote for their senate seat, which is why Peter Watts received only 15 votes. But except for that one mal function, the computer system worked well and enabled the board to return results much faster than previous years. At the final tally, 1,942 students voted, which is 341 more votes than last year.
