Old-growth logging tried
in environmental lawsuit

EUGENE (AP) — Environmen
talists plan to ask again for an in
junction to stop logging the last
old-growth trees under the salvage
rider now that part of the law has
expired.
“Even if there is only one timber
sale left, I think it would be worth
suspending logging to make sure
there was no environmental dam
age,” Kristen Boyles of the Sierra
Club Legal Defense Fund said
Tuesday.
The U.S. Forest Service and
U.S. Bureau of Land Management
were working Tuesday to produce
a list of an estimated 10 million
board feet of old-growth timber—
enough to build 625 typical wood
frame houses — that has yet to be
cut out of about 380 million autho
rized to fall by the salvage rider.
The list was ordered by U.S. Dis
trict Judge Michael Hogan at a
hearing Monday.
Logging of old-growth forests
under the salvage rider was the fo
cus of heated court battles and
protests by environmentalists this
year and last, resulting in hun
dreds of arrests.
The main portion of the July
1995 legislation waived environ
mental laws to speed the salvage
logging of dead and dying timber
on the nation’s forests to prevent
catastrophic wildfires. It expires
Dec. 31.
However, the bill also revived
about 380 million board feet of
old-growth timber sales in Oregon
and Washington dating from 1989
and 1990. That provision expired
on Monday.
The sales originally had been
canceled because of environmen
tal concerns, but were revived by
Congress to cut $200 million in
potential claims from the timber
buyers and bring in $300 million
in revenue.
Environmentalists argue that
since the portion of the law autho
rizing the sales has expired, any
trees that have not been cut should
be left standing.
The Forest Service and BLM al
ready have suspended logging on
several of those tracts until they
can be assessed for dangers to en
dangered and threatened species.
However, the federal govern
ment has taken the position that it
must honor the contracts held by
timber buyers.
Environmentalists plan to ex
amine the list of uncut old growth
to see which ones are likely to
cause irreparable harm to fish and
wildlife and ask Hogan to stop
them, said Mark Hubbard of the
Oregon Natural Resources Coun
cil. They could go to court this
week to seek a temporary restrain
ing order.
The timber industry intervened
in the case on the side of the gov
ernment, which has been its oppo
nent in many of the earlier court
battles over the salvage rider.
