ASUO University Affairs Coordinator, that Kramer be removed for non fulfillment of duties Kramer is challenging the impeachment on prot edural grounds, claiming that he was provided with insufficient notice and that the senate is vio lating his due pnx ess rights Kramer claimed the impeach ment hearing constituted a "contested case hearing" under Oregon law and that the hear ing's pnx edure was governed by the Oregon Administrative Pro cedurw Act. The OAPA requires that both parties in a contested case hear ing follow quasi-judicial rules of procedure, including the right to present evidence and cross examine witnesses Various senators and ASUO President Kric Howen sharply disagreed with Kramer and his attorney. Douglas Minger. at Tuesday's meeting, asserting that the senate was not an offi cial state agency and not subject to the OAPA. "He's hiding under pnx edur al niceities," Howen said. Huckuha said the ASUO Con stitution should he considered the controlling law in the mat ter. "Student government is given a guideline under which to work," Huckabn said. "1 would just like the opportunity to go through the proc ess I've been given." he told the senate Kramer said the ASt’O Con stitution merely provided ,i framework for student govern ment. and the particulars were filled in bv state law. who h "you can't wish awnv for expe dience." he said. Bowen argued that, lacking specific: provisions to the con trary, state law is not i ontrol ling.
