(AP) — A mother of four who was ordered to stub out her cig arette after lighting up in a no-smoking section relumed with a 12-gauge shotgun and killed one of the restaurant patrons who complained, police said. In a state that leads the nation in restrict ing smoking in public areas, the slaying in this San Francisco suburb drew conflict ing opinions from pro- and anti-smoking advocates. "While no one can condone that vio lence, a possible explanation of it is the kind of nasty, state-sponsored ads they bombard Californians with that ridicule smokers," said Thomas Lauria of the Tobacco Institute in Washington. Americans for Nonsmokers' Rights termed the killing a bizarre act of violence that cannot be interpreted as a sign of smokers' frustration. “The tobacco industry wants to create that perception, but that's not at ail what's happening." said spokesman Kevin Goebel. "The vast majority of smokers agree that we need to prohibit smoking in public places." Police detectives were not available for comment Wednesday, a secretary said. But according to previous police state ments, the shooting early Saturday morn ing was prompted by an argument over smoking in a Danny's restaurant. Arrested for investigation of murder was Daphnye Luster. 22. of neighboring Rich mond. She was held without bail. The 20-year-old victim. Rachel I Rashan Houston, was shot in the head as she drove away from the restaurant. According to reports, the altercation began when Luster lit a cigarette in a non smoking section. Houston and four other women at another table complained to the manager, who asked Luster to put out the cigarette. For every 1,000 women aged IS to 19 in 1991; the Centers for Dis ease Control and Prevention reported 62.1 births, up from 59.9 births the year before. The CDC has no way to calculate the nation’s overall teen preg nancy rate — which includes births and abortions — because 10 states keep no figures on abortions. But tallies released Thursday showed Georgia had the highest preg nancy rate among the states that do report — 110.6 pregnancies per 1.000 teen-agers in 1990, the latest state-by-state data available. North Dakota had the lowest rate, 56.4 pregnancies per 1.000 teens. The birth rate to teen-agers was highest in Mississippi, with 81 births per 1,000 teens, and second in Arkansas, with 80.1. The CDC said the incidence of teen pregnancy depends on acces sibility to family planning services and other factors that vary from state to state. It urged state officials to attack the problem. “We’d like every pregnancy to be a wanted pregnancy,” said epi demiologist Alison Spitz. "We're very concerned since teen preg nancy is likely to result in children who are low birthweight, slow or to develop and have higher infant mortality." From 1980 to 1990, the rate of teen pregnancy declined more than 10 percent in seven states and the rate of teen abortions dropped more than 20 percent in 15 states.
