The three-day trial included
testimony from the woman, her
roommate, Horton and a host of
defense witnesses who spoke
on his behalf.
The woman testified that
Horton and his then 16-year
old cousin took her to their for
mer residence in north Eugene
and had sexual intercourse
with her against her will.
She said that she repeatedly
asked the two men to take her
home and that they ignored her
struggles and pleas to be left
alone.
The woman admitted heing
intoxicated and accepting a
ride from Morton prior to the
incident. but maintained
throughout the trial th«it (lit* in
tercourse occurred entirely
vs ithout her consent
"I fell like I was being domi
nated by two people I felt they
had done something I didn't
want done to me," she said
Horton contended the wom
an initiated the conversation
and subsequent sexual activity
between them and in no way
resisted or struggled.
"She came on to me." Hor
ton testified "Shi- initiated it ”

Horton's cousin, corroborated
Horton's claim that tin1 woman
was dam ing suggestively and
acting in an aggressive manner
during the fniti’riiity party.
Horton’s cousin also testified
that during I ho incident, the
woman made no attempts at re
sistance. never said she wanted
to go home and " made state
ments that led me to lieliave
she wanted to continue
The cousin, a minor, is lac
ing charges tor tiie incident in
juvenile court.
