Burr was concerned that in coming students would not have an opportunity to have a voice in how their fees are spent. Burr maintained that allocating student fees is an an nual function of the IFC and to earmark funds further into the future than one year contradicts the incidental fee process. Malarkey said the intent of the incidental fee concept is to give students the right to control their own fees — an amendment such as the spring vote is constitutional. He cited other instances of, referendum votes at the University. Burr wondered whether a discrimination based on political view was used by OSPIRC in its choice of lobbying issues for lob bying. However, he said he knows of no instances of anyone being refused participation in OSPIRC because of personal views. Malarkey retorted this saying OSPIRC has open meetings, an nual and open voting at each chapter and the lobbying issues are determined by surveys, with the issues showing the most con cern by consumers receiving the most consideration. Burr argued that because OSPIRC receives state funds, its workers can be considered state employees and as such they violate state law. Malarkey said OSPIRC is a private non-profit corporation and the money it receives from the University goes to the corpora tion, and its employees are paid by OSPIRG. He also said the court is not the proper place to rule on state laws. Burr's final contention centered on OSPIRG being a cor poration. He cited an incident when University Pres. Paul Olum moved to remove a corporation from campus. At this time Con treras interjected to say that Olum had only stalled the issue and no precedent had been set. During rebuttal Burr stated that the two-year funding infring ed on student's rights and Malarkey argued that students ex pressed their wishes when they voted for the referendum. EMU Board approves renovation funds Board members approved a $1.7 million renova tion project for the EMU's second floor, said EMU director Adell McMillan at the student union's board meeting Wednesday night. McMillan stressed that no tax dollars will be used for the fund. “The money for the project is coming out of the building fees paid by students at the beginning of the first term," she said. The search for an architect will not begin until fall term's end, McMillan said, and no date has been set tor the renovation project's beginning. The Board also voted to retain summer Chair Dan Cohen at that position and Maria Neese as chair of the House subcommittee. A recent request by the ASUO to use microphones once a week in the free speech yard led the board to organize a special meeting to draw up specific guidelines for their use.
