Texas executes killer by injection
HUNTSVILLE, Texas (AP) -
Convicted murderer Charlie
Brooks Jr. was executed by
lethal injection early Tuesday,
becoming the first U S prisoner
to be put to death by that meth
od, according to Tim Davis, a
state trooper at the governer's
mansion in Austin
The injection of sodium Pen
tothol was administered at 10 09
p m PST, and the 40-year-old
Brooks was pronounced dead
seven minutes later
Prison authorities conferred
with Gov William Clements at
10:01 p m., and were informed
that no stay had been granted
Brooks was the first black and
only the sixth person to die
since the U S Supreme Court
allowed reinstitution of the
death penalty in 1976 Texas'
last execution was in 1964
Former Terrant County Dis
trict Attorney Jack Strickland,
who prosecuted Brooks, joined
the requests for a stay of ex
Appeals court upholds
suburb’s handgun ban
CHICAGO (AP) — A federal appeals court Monday
upheld the nation's toughest gun ordinance, ruling that the
Chicago suburb of Morton Grove acted within its authority
when it banned the sale and possession of handguns.
In a 2-1 decision, the 7th U S. Circuit Court of Appeals
rejected arguments that the ordinance enacted last year
violated provisions of the state and federal constitutions that
guarantee the right to bear arms
Justice William Bauer, who wrote the 18-page majority
decision, said he agreed with a U S. District Court ruling
which held that the village acted within the police powers
granted by the state constitution in outlawing sale and
possession of handguns by anyone except law enforcement
officers and registered gun collectors
While "history may prove that the ordinance cannot
effectively promote peace and security for Morton Grove's
citizens,” it does not violate either constitution, Bauer said
In a sharply worded dissent. Justice John Coffey called
the majority ruling "a new nadir for the fundamental principle
that a man's home is his castle ” '

Appeals said the latest appeal
did nothing to show that the
evidence failed to support the
conviction as well "as the jury

capital sentence."
Brooks was among 172 peo
pie, including two women,
under sentence of death in

the roof down on the crowded
dance floor of a bar frequented
by British soldiers Monday
night Police said at least five
people were killed and the

five have been confirmed
