EQUITY POWERS Of A COURT
PROVE "DELICATE" AREA
A court In an eastern city several
years ago granted an injunction at
the request of Sklar that enjoined
Mulvey from entering the Sklar
home. It also provided that Mulvey
was not to "threaten, communicate
with, touch or otherwise interfere
with"Sklar's wife, or the two Sklar
children. The trouble between the
Sklars and Mulvey began when
Mulvey moved into the same
neighborhood. Mulvey Immediately
started annoying Mrs. bklar by try
ing to persuade her to leave her
husband and run away with him
He entered her home several times
in his attempt to convince her. He
also threatened her with a revolver
and said he was going to abduct
one of her children,
Sklar did not take any legal c
tlon at the time because he want
ed to avoid any notoriety. The
Sklars finally moved to another
neighborhood and Mulvey followed

them. Later, Sklar moved his fam
ily to another state but Mulvey
till alternated to locate them. At
this point the injunction was sought
and granted.
In another case from the same
eastern city a few years later, a
judge granted an injunction at the
request of Mrs. Maling that en
joined Miss Moreland from going
around with Mrs. Maling's husband.
After this decree, Mrs. Maling
discovered Miss Moreland had been
in a restaurant with Maling and
had ridden around in an automo
bile with him. She asked the court
to oumsh Miss Moreland for con
tempt of ita decree, which the
court did.
Because of the difficulty in en
forcing such decrees, many courts
would not agree with these two
cases. There are courts, though
that will undertake even more diffi'
cult tasks of enforcement. For ex
ample, one court issued an injunc
tion against all love affairs be
tween Mrs. Thompson and Mr
Beach. She was further ordered
to go away with her own husband
and lorget alt about ueacn. ine
court also decreed that she could
not write to Beach, nor could she
enter the city he was in without the
court i permission.
All of these cases Involve courts
exercising "equity" powers. The
equity powers of a court refer to
the authority to order an individual
to do or retrain Irom doing some
thing specifically. Equity also has
the power to enforce such an or
der by punishing the individual for
contempt ot tne court u be dis
obeys.
This area is rather a delicate
one to attempt to regulate by court
decision. There are, however, those
courts which freely grant relief that
is requested and these courts are
probably increasing in number.

LegislahVe Interim Committee
Plays Important Role In Oregon
SALEM (AP) Only a few years
ago. legislative interim commit
tees did very little. And when they
did anytning, tne Legislature usu
ally paid little attention.
These committees often were
created to dispose of problems
that the Legislature did not want
to face. It used to be said jokingly
that interim committees some
times were created just to bury
legislation.
The committees used to meet
only one or twice between ses
sions. They couldn't do much, any
way, because they had no techni
cal staffs to help them.
Now, interim committees have
become a very important part of
the legislative process. In fact,
they introduce a big share of the
major new laws which they draft
as the result of long hours of study
and hearings.
More than half the legislators
serve on these committees. They
have executive secretaries and
stenographers, as well as research
experts, The members . spend
many days between sessions in
committee work.
Committees in the 1959 legisla
ture have until Oct. 15 to file their
reports. 1
Some have not yet decided what
they wilt recommend. But they

portant, far-reaching legislation to
be introduced.
For instance, the Interim Com
mittee on Taxation will recom
mend lower income taxes, a 3-cent
a package cigarette tax, and a
new timber tax system that would
encourage sustained yield pro
grams. The Criminal Law Committee
would control obscene literature,
require judges to hold pre-sentence
investigations, and provide
parole supervision for all men re
leased from prison.
And the Committee on Educa
tion favors a long-range plan to
provide 50 per cent state support
for schools, compared with 36 per
cent now.
The Agriculture Committee
wants more farm research, and
the Labor-Management Commit
tee will sponsor highly controver
sial legislation that would have
Study Shows Family Farm
Is Far From Down And Out
NEW YORK (AP)-The family
farm is far from down and out.
That is the cheery word from a
study of early reports from the
latest tally on agriculture by the
Census Bureau.
The total number of farms has
dropped in - the last five years,
giving rise to fears that the fam
ily farm the small- and middle
sized holding was in danger.
But reports from 23 states, first
to be released in the 1959 census
of agriculture, show only small
gains in the number of corporation-type
farms with 1,000 or more
acres in the last five years, and
only a slight increase in the num
ber of farms of 500 acres or
more.
The decline was In the marginal
farms, while middle-sized holdings
have held their own and gained
; modestly in size.
The farmer's problems are well
! publicized. They include declines
in total income, increases in op
erating costs, levelling, off or de
clines in prices, both of farm
products and farm land.
But the Department of Agricul
ture has come good news this i
week. It says crop and weather
conditions in October point to a
record total farm output this year.
On the reverse side of the coin, I
the department reports that the
government has $8.82 billion in
vested in price-supported surplus
farm commodities on Aug. 31.'

The Public Welfare Committee
has many suggested changes in
the laws. And the Legislative Fis
cal Committee wants the state
university and colleges to make
better use of their space.
Important changes probably will
be suggested by the Legislative
Counsel Committee in the way of
removing conflicts and lack of
clarity in many laws.
These are only a few of the
proposed bills that committees
will sponsor.

about what a legislature will con
sider by reading the reports of its
interim committees.

The Census Bureau estimates
the United States has four mil
lion farms, a decline of 800,000
since the last tally in 1954. But
200,000 of the drop is due to a
change in Census Bureau defini
tion of what is a farm. It has
eliminated the very smallest hold
ings, especially those with only
small sales of products,.
In seven eastern states the bu
reau finds the average size is 164
acres, in nine central states it's
267 acres, and in seven western
states the average size ranch is
1,018 acres.
In the eastern states there were
857 farms with 1,000 or more
acres, a gain of 24 in five years.
In the central states the number
was 31,530, up 3,000.
