In calling for new arguments next fall, the court in an order said the U.S. attorney general had not been advised formally that the constitutionality of a section of the Railway Labor Act was at issue. The court certified to the attor ney general that there is a con stitutional issue in the case. The appeal on which action was deferred was taken to the high tribunal by a group of unions. They appealed from a Georgia Su preme Court ruling that a union shop provision of the Railway La bor Act violates constitutional rights of workers. Six veteran employes of the Southern Railway System who did not want to join unions protested in Georgia courts against paying union dues when part of the money was used for political purposes and to aid doctrines the workers opposed. Under union shop agreements, workers are required to join un ions within a specified time if they wish to hold their jobs. In the Georgia railroad case the time limit was 60 days. Georgia courts ordered unions to return to complaining railway em ployes the dues they paid under protest and under threat of losing their jobs. The state courts also barred enforcement of two union shop contracts involved in the case. The Georgia Supreme Court, up holding contentions of the six em ployes, said: "One who is com pelled to contribute the fruits of his labor to support or promote political or economic programs or support candidates for public of fice is just as much deprived of his freedom of speech as if he were compelled to give his vocal support to doctrines he opposes." The Georgia court found dues money was used extensively to help, candidates at the federal, state and local levels. The U. S. naval fleet has had only one admiral. George Dewey was the only man commissioned "Admiral of the Fleet" in U. S. naval history. Kvale was accused of telling stewardesses that he might have a bomb in his luggage while on a Northwest Airlines flight - from Portland to Minneapolis late Tues day night. Ook OR 3-5521 Stripe Rust Outbreak Hits Epidemic Stage In Idaho MOSCOW, Idaho (AP) Stripe rust, a crippling disease which strikes winter wheat crops, has reached epidemic proportions throughout central Idaho and east ern Washington, a plant patholo gist from the University of Idaho said Saturday. Dr. Harry Senwick said, "little can be done but sit back, watch and hope." New To Region The disease is new to the area, and there is no effective remedy, Senwick said. "The onlv control is the weather hot dry weather appears to deter development of the rust, but it literally explodes during cool moist weather, such as the area has experienced this week," he said. All but Portland had more peo ple within their city limits, but the greatest growth was in the suburbs. Metropolitan Seattle had a 29.9 per cent increase, rising above the million mark to 1,096,778 from 844,572. Within the city the in crease was 17.7 per cent from 467, 591 to 550,525. Suburban area pop ulation went up 44.9 per cent from 376,981 to 546,253. Figures for the three other cities with the population for 1960, 1950 and percentage increase or de crease, in that order: Metropolitan Portland, 815,745 and 704,829, up 15.7 per cent; city, 370,339 and 373,628 down 0.9 per cent; suburbs, 445,406 and 331,201, up 34.5 per cent. Metropolitan Spokane, 277,745 and 221,561, up 25.4 per cent; city 179,729 and 161,721 up 11.1 per cent; suburbs, 98,016 and 59,840, up 63.8 per cent. Metropolitan Tacoma, 318,258 and 275,876, up 15.4 per cent; city, 146,734 and 143,673, up 2.1 per cent; suburbs, 171,524 and 132,203, up 29.7 per cent. Smoking Said Connected With Coronary Disease SPOKANE (AP) "There is no doubt under the sun ' that cigar ette smoking is associated with coronary heart disease, a convea tion of Northwest Osteopathic Phy sicians and Surgeons was told Monday. "Whether smoking is a cause of the disease is something else again," Dr. John W. Gofman of the University of California said in the first of four lectures he will give during the three-day meet ing. Smoking is one of 20 factors which hve been shown through clinical study to be associated with coronary thrombosis, he said. Nearly 2,000 osteopaths have registered for the conference.
