WASHINGTON (AP)-The U.S. I Court of Appeals has upheld the : State Department's denial of a ! passport to Rep. Charles O. Por ter (D-Ore) to travel in Red Chi na. A three judge panel of the ap pellate court unanimously reject ed Porter's contention that as a member of Congress he has a right to go anywhere in the world except in lime of war or emer gency. The court said Ihe rase did not involve any conflict between op posing claims of constitutional powers of the legislative and ex ecutive branches of government. Porter contends there is such a conflict. The litigation arose when Por ter applied last June for permis sion lo visit Red China. Ilis ap plication was denied and he car ried the case lo court. Saalfeld, deparlmenl di rector, said today thai those who apply this month won't be able lo gel their loans until April, 1961. The department reached the lim it three months ago ot the amount of bonds it can issue for loans. The only money it now has available comes from loan repayments. There will be a measure on Ihe November ballot to give the de partment authority lo issue an other 104 million dollars worth of bonds.
