Jurisdiction Issue In Portland Press Litigation PORTLAND (AP) A demur rer filed by attorneys for the Ore gontan Publishing Co. here has ar gued that slate Circuit Court here lacks jurisdiction for a criminal contempt citation asked against the newspaper. Levi S. McDonald, indicted for a part in the dynamiting of 10 trucks that hauled for Portland's two struck newspapers, nsked the citation on Hie grounds that news paper violated the law. McDonald's complaint alleged the violation came when the news papers printed before he appeared before grand jury hearings the con tent of signed statements accu sing bim of a part in the bombing. The publishing company demur rer saitl the newspaper accounts "do not constitute any clear and present danger of serious and imminent threat to the orderly mid impartial administration uf justice." The demurrer said the affidavit by McDonald does not stale suf ficient fads to require the news paper to appear and show cause why it should not be punished for contempt. It also said (be statements were published under the guarantees of liberty, due process, freedom of the press and freedom of speech provided by the V. S. Con stitution. McDonald was on the negolia tint com in it lee of the S'ereoty pers I'nion, which struck the Ore gnmau and Oregon Journal Nov. 10. The contempt petition also cited (lie Journal Publishing Co. an.
