On President May Be Sidestepped
By High Court In Steel Seizure Case

WASHINGTON (AP) - In the steel dispute which
was argued Monday the Supreme Court can do several
things without deciding flatly on the basic question before
it:.The constitutional limits on a President.
Usually the court doesn't hand down a single, flat opin
ion on broad constitutional questions. Instead, it decides
specific issues which may be a part of a broad problem
without running headon into the problem itself.
For example, this court has
handled case after case Involving
the wide question of segregation
of Negroes. It has never ruled on
whether segregaiion as a whole
i good, bad, constitutional or un
constitutional. It has ruled on specific examples
nf segregation brought before it.
It has said Negroes must not be
forced to ride in the rear of buses
crossing state lines.
And it has so ruled that Negroes
now are admitted to white gradu
ate schools in the South without
saying Negroes had to be admitted
to white high and grammar
schools. When it got a case invol
ving graduate schools, it limited
its ruling to graduate schools.
What Court Can Do
And, without giving an opinion
of any kind, the court can send
the steel dispute back to the U.S.
Court of Appeals or even to Dis
trict Judge David Pine for more
arguments or findings. It was Pine
(Wno said the President exceeded
his power in seizing the mills and
ordered them given back.
If it wants to give an opinion,
(he court could do so quickly. Per
haps In days. Maybe In weeks.
Or it could delay its opinion If it
was long delayed a steel settle
ment might then make an opinion
unnecessary
The problem that goes to the
court as the heart of the steel
dispute is this:

ent. He reported the suicide note
ended with this sentence:

a first class ship of the fleet, after
she had performed every job she
was called to do in the Korean war
. . .and less than a month before
she headed home."
Kilpatrick said Hopping asked for
shore duty after he had been
aboard six weeks.
The officer said that was not
enough sea duty to qualify Hop
ping for a transfer so his request
was turned down. '
