appealing to the highest court in
their effort to throw out the 194$
initiative measure which bans all
fixed gear, such as traps and
seines, from the river and its trib
utaries. The Oregon supreme court ruled
that the measure is constitutional.
This ruling reverfed Circuit Judge
(ieorge Duncan of Salem.
The trap and seine operators, in
their petition to the United States
supreme court, rays that the new
taw viofttes the United States con
stitution by depriving them of their
property without due process of
law.
They claim the law gives the
state an unreasonable exercise of.

the law gives the gill netters a
monopoly, thus depriving the seine
and trap operators of equal pro
tort ion under the laws.
The law exempts certain Indians
under federal regulation, so the
trap and seine men say this vio
lates the federal constitution.
