'Trenton Six'
Face New Trial
Without Lawyers
TRENTON, N. J. UP) Con
victed once of murder, six Tren
ton Negroes, known as "The
Trenton Six" face a second trial
without the services of three law
yers who helped save them from
the electric chair.
Mercer County Judge Charles
P. Hutchinson has ordered the
attorneys off the case. The three
hired by the left-wing Civil
Rights Congress to defend the
Negroes are former Assistant U.
S. Attorney General O. John Rou
ge, Executive Secretary William
L. Patterson of the Congress and
Emanuel H. Bloch, all of New
York.
In an eight-page order bar
ring the trio from practicing
in his court, Hutchinson said he
could no longer endure their
"studied discourtesy and con
tempt for the court." He ac
cused both the attorneys and
the congress of unethical prac
tices. Charging that the congress col
lected from the public "moneys
far In excess of those necessary"
to finance the defense, he said:
"This situation raises grave
doubt as to the real purpose for
which these funds were collect
ed and. as far as I have been
able to learn, there has been no
accounting of the funds received
or the moneys disbursed."
He said he had heard reports
that collected money was used
by the congress for "defense
of another case pending about
the same time In another Jur
isdiction." He did not name the
other case.
The judge accused Rogge, Pat
terson and Bloch of violating the
American Bar association's code
of ethics.
All of vour expressions have
vehemently denounced the trial
of these defendants as unfair, bi
ased and prejudiced in varying
terms running from a travesty
of justice' through the gamut of
'an outrage,' 'a northern Scotts
horo case' to a 'lynching,'"
Hutchinson said. "You have de
liberately distorted the facts with
a view of stirring up unfavor
able public opinion against this
court.
Hutchinson presided at the
original trial In 1948 of the men
whom the congress calls "The
Trenton Six." After the Jury
found the Negroes guilty of
slaying 72-year-old William
Horner, Trenton store-owner,
the Judge sentenced all six to
die In the electrlo chair.
However, the state supreme
court set aside the verdict and
ordered a new trial. Rogge, Pat
terson and Bloch were among
the lawyers who successfully ar
gued the appeal.
civil Mights Congress officials
and the three lawyers greeted
news of Hutchinson s removel or
der with promises to continue
tnelr HEM lor the defendants.
They said they did not know
whether the removal order could
be appealed, but would seek to
do so.
