Discrimination In Housing
Rapped By New U.S. Policy

... WASHINGTON, (JB The government has announced a new
policy to try to cut down It cannot wipe out racial discrimination
in housing.
.This la the background, with an explanation from government
officials on what the new policy means.
It has been a widespread practice in this country for property
owners In a community to discriminate against whole groups of
people because of their race, religion or color, particularly Negroes
and Jews. . , ,
They may agree among them
selves that none of them will
ever rent or sell his house to a
negro, for example. This Is a so
called "gentlemen's agreement."
Sometimes it is called a "restric
tive covenant."
Suppose one of the people
making the agreement broke it
and sold to a Negro. Whit could
the other's do to stop him? Noth
ing. It was only a verbal agree
ment anyway.
But there is another kind of
agreement it's still a restrictive
covenant which is called a "re-

corded" agreement. Meaning, It
has been filed in writing in a
court as part of the court re
cord, for example:
Say you buy a house today. In
the deeds to the house It is plain
ly stated that the owner, in this
case you, cannot sell to a negro.
This may happen in a n e w
house you buy today or in an
old house that's changed hands
10 times in 20 years.
That restrictive covenant was
in the deeds when the house wa3
first bought. It was recorded 20
years ago. When you, the 11th
owner, buy it today, the deeds
with their restrictive covenant
are still part of the court re
cord and have been for 20 years.
But suppose you decide to sell
to a Negro and your neighbors
want to go to court to prevent
the sale, arguing that under the

Era" described Woods as the
first man to give publicity to a

Woods is publisher of the We
natchee Dally World and recent
ly was named by his town as
"the man of the year."
Of Woods, the Reclamation
writer says he "has the common
touch and loves people " and
has been the human dynamo that
has kept the reclamation project
on page one in the press of the
nation.
"He is a symbol of what Indi
vidualism, working with a pro
gram and the willing help of oth
er progressive men on a team,
can achieve."

down the railroad tracks for 9.2
miles in one hour 36 minutes anu
20 seconds. .
Onlv five of the 10 starters in
this year's race finished. The
event is sponsored by former
Mayor George Baker who told
how his grandtather used to mak
the walk with a sack of wheat in
an hour and 55 minutes. Doubt
was expressed whether a young
man today could do as well.

you? No. That was tried a couple
of years ago. But the Supreme
court ruled such "recorded"
agreements have no standing in
a court In other words, the
agreement is not worth the pap
er it's written on If someone
wants to break it.
Now we come to the new
policy, which involves the Feder
al housing administration (FHA).
FHA is a government, agency
which insures loans for people
who want to build private homes
or even whole private housing
projects, in tne past, year it nas
insured one-third of all the private
housing built.
Some time in the future may
be 60 or 90 days FHA will set
up a rule which says:
No one can get an FHA loan if
he is a party to one of those re
strictive covenants "recoraea
AFTER the rule went into ef
fect. Suppose, after the rule goes In
to effect, you want to buy a house
whose deed, recorded in a court
years ago, carries the restrictive
covenant. Can you get an FHA
loan to buy that house?
Yes, says Franklin D. Rich
ards, head of FHA. Why? Be
cause the covenant was "record
ed" before the new FHA rule
went into effect. The rule will
bar loans only, to those putting
such agreements into a court re
cord after the rule becomes effective.
