Hiss1 Motion For 2nd Trial Shift Is Turned Down NEW YORK. Oct. 17. (. ger Hiss' motion lor transfer of hi! second perjury trial to Ver mont was den I'd Saturday. The former high state depart ment official had asked for the transfer on grounds that he could not get a fair trial in New York, where his first trial ended in a Jury disagreement. Federal Judge Alfred C. Coxe rejected the transfer motion. Hiss' second trial is scheduled to begin Nov. 1. He is accused of lying when ne denied passing State department secrets to VVhittaker Chambers for transmittal to a pre-war so viet spy ring. Chambers, former Time Maga zine senior editor, who now is a Maryland farmer, has admitted being a one time communist cour ier and has testified that Hiss gave him official secrets. Coxe noted that federal rules of criminal procedure permit a trial to be shifted if there is "so great a prejudice against the defend ant that he cannot obtain a fair and impartial trial In the district where the prosecution Is pend ing." "I find nothing In the papers submitted on the present mo I'on," Coxe said, "to Indicate that there exists in this district any such prejudice."
