made the ruling against the 28-year-old
film player on a charge
brought by Miss Florence G.
Heppenstell, 26, of Worcester.
The film player and the cash

heard the verdict. Both appeared
calm.
Kirkwood's counsel, Atty. Na
than Fink, said he planned an
appeal.
Kirkwood said today: "I h a v e
never seen the kids and have no
desire to see . them. I have no
Interest in her either." .
Then he added:
"I would like to help the kids
excent for the fact it would read
to-) much like an admission of
guilt."
Kirkwood, who is also a pro
fessional golfer, said in an inter
view Miss Henoenstell was "a
slight acquaintance" and one of
manv waitresses he met at
New Hampshire club where h e
worked in 1942.
The twins were born In April,
1942.

Union Pacific Denied
Request To Cut Rates
WASHINGTON, July 25 WP
The Union Pacific railroad has
been turned down for the third
time by the Interstate Commerce
commission on a request for au
thority to cut petroleum freight
rates between Salt Lake City
and the Pacific Northwest.
The ICC refused to vacate an
order suspending until the end
of the year a revised plan sub
mitted by the railroad for reduc
ing tralnload and single car
charges.
Further Investigation Is due,
however, on the proposed rate
revisions. Five members of the 11
man commission favored vacat
ing the suspension order on cer
tain conditions relating to large
quantities of petroleum products
handled as a single shipment.
The Union Pacific filed a peti
tion for rate cuts several months
ago after the Standard Oil Co.,
had proposed construction of a
petroleum pipeline between Salt
Lake City and the Northwest.
Ex-Movie Player Found
Dead Near Open Gas Stove
SEATTLE, July 25 UP) A
former motion picture bit player,
Don K. Evans, 24, was found dead
in a highway auto cabin Thurs
day. His head was near the open
oven door of a gas stove, coron
er's deputies said. Three top
burners were turned on.
Evans, who was unemployed,
faced a charge of petty larceny
In justice court here. He was
accused of having issued a worth
less $25 check last March. He
had been scheduled to appear in
court on the charge.
His father, Walter A. Evass,
said his son had been in poor
health since he was injured In an
automobile accident two years
ago and had suffered two nervous
breakdowns.

The Pioneer Memorial Hospital
association, which raised $384,.
