90 Cited by Court
In Tax Decision
WASHINGTON UP) A man
.who can still do a triple-heel-click,
in mid air at age 90 obviously isn't
.thinking about dying.
Therefore, ' the United States
Tax Court ruled, Oliver Johnson
wasn't trying to beat the govern
ment" out of Inheritance taxes
when he gave most of his money
to his children.
The Internal Revenue Bureau
had claimed otherwise.
Johnson, a highly successful
Kansas (Republic County) farmer
.who moved to Long Beach, Calif.,
when' he was 71, gave $255,950
worth of property to his children
themselves aged 50 to 68 when
he was 90 years old. ' "
He paid $11,266 in gift taxes
in this transfer. When he died in
1943 at the age .of 94, he left an
estate of only $49,433. But the
Revenue Bureau said that gifts
by a 90-year-old must have been
made "in contemplation of death"
and therefore were subject to es
tate taxes as jf they had ben
made in a will.
So the court asked itself if
Oliver Johnson was the sort of
90-year-oldster to be contemplat
ing death and, after examining
his lively ways, came up with a
resounding no.
r'To demonstrate his agility (at
90 years, four months) he jumped
into the air and clicked his heels
together two or three times be
fore descending to the floor,'.' -the
court exclaimed.
"He regarded himself as
younger than other old men not
yet his age and would comment
with ridicule upon their elderly
appearance.
"He frequently stated that he
expected io live to he 1Q0 years
old."

MUNICH, Germany, April 27
UP) A Bavarian denazification
court has convicted Baroness Erna
von Redwitz, a .native American
citizen, of being a follower of
Nazism. Charges have been filed
against a second U. S. citizen.
Both actions were taken in the
absence of the defendants. They
were the first denazification
charges to be filed in Bavaria
against any persons other than
German citizens. The Germans
obtained permission from the
military government to proceed.
Baroness von Redwitz, now pre
sumed to fee living in Chicago,
was ' fined' 2,000 marks. (The
mark, .valued at 10 cents at the
military rate of exchange, is now
, held at 30 cents for most pur
poses in the American and Brit
Hsh zones.) In order to' regaln
property she left in Germany she
must come here and present a
claim.
Richard J. Franke, 42, a German-born
American citizen, has
been indicted by .German officials
as an early member of the Nazi
party. Franke, an interior decora
toi, Is listed as a resident of De
troit:, Mich. Both' Ihe Baroness
and Franke were repatriated to
the United States after the war
because neither had lost Ameri
can citizenship.

The Food and Drug Administra
tion has sent 300 inspectors and
chemists on a nationwide round
up of a contaminated glucose
shipment reported capable of
causing injury or death.
An FDA official said three
deaths are known to have oc
curred after patients were given
injections of the ' glucose-saline
solution. He said, however, that
the patients ' in all cases were
quite ill previously. "
The official said the deaths
were reported from Hazard and
Louisville, Ky., and Miami, Fla.,
besides those places, injuries also
have been reported from injec
tions in Birmingham, Ala., ar.d
Albany, Ga., he said. Ten injuries
' have been listed thus far. "
' The drug being sought in
every state is called "Code No.

should be given to the needs of
the rural church. '
He suggested some sort of a
minimum salary arrangement to

little representation at past con

area containing 42 per cent of
the church population.

Sift flour Before measuring.
Use level measurements for all ingredients.
Preheat oven to baking temperature, 32, a slow-moderate oven.
Have all ingredients at room temperature (about 70).
Measure all ingredient before starting to mix cake.
Have ready an ungreascd tube pan, 10 in. diameter, A in. deep.
Sift together into a mixing bowl

Wake a well in center of dry ingredient! and add in order listed

Beat with a spoon until u forms a smooth batter. In a very large
mixing bowl place -

Vi teaspoon cream of tartar
Whip (using hand whip, roury beater, or electric mixer) until
wliitES form '.ciy uirl peaks. Jo not underbeat (Whites should
be much stifTcr than for angel cake or meringue.) Then pour
batter slowly and gradually over stiffly beaten egg whites, while
gently folding in with a rubber scraper or large spoon. Fold in just -until
blended; do not stir. Pour immediately into the ungreased
tube pan. bake in preheated oven, for 1 hour 1) minutes. .When
done, top surface of cake will spring back when lightly touched
with the fingers, and the "cracks' will look dry. Take from oven
and immediately turn pan upside down, placing the tube part over
neck of funnel or bottle. Let hang, free of tabic, until thoroughly
cold. Loosen cake from sides and tube with spatula. Turn pan
over and hit edge sharply on tabic to loosen. Frost I
or not as desired. 16 to 20 servings.
