today a Multnomah circuit court
judgment awarding State Senator
Isaac 10. Staples of Tillamook $7,100
damages for personal injury
against the estate of Eugenia J.
Rothschild.
Staples was fnjurod when he
fell through a trap door Into the
lmseiuent of a building owned by
the estate, the building being lo
cated at S. V". Third avenue and
Colutublu street in Portland.
Staples contended there would
have been a railing around the trait
door. The lower court ruled that
tho defendant was negligent, but
the higher court ruled them was
no negligence. The decision, by
Justice Lusk, reversed Circuit
Judge Winter.
