-Among the problems that the next' session of 'Congress
: wilQacklo will be, probably, the knotty question of the powt
ers fyhich devolve on the president as a result of his consti
tutional position as commander in chief of our ttrmed. forces.
This .question was raised .in- the last session connection
wilhrtho dispatch of marines to' Nicaragua, but' was not
fully.cliscussed. Doubtless' the' senate will consider it again,
however. The constitution fives congress sole power to de
clare war, but it gives the president powers ovor the army1
and navy -which enable him to put the country in a' state of
wac without any declaration by congress, Buchanan has
been'.the only president since Jefferson who. did :iiotr feel
that the president could land aiimed' forces on foreign soil
witttout congressional consent. All the others have assumed
that ho could. It hus been pointed out that-a president
could, force tho country into war without consulting con
gress at all ; and tho whole constitutional question doubtless
wili.be discussed in the senate. 'It may be guessed that the
situation will remain unchanged. Our tendency of late has
beeiilo lodge more nnd more power in the hands of the presi
dent? and it is doubtful if this tendency' will change now.
