for termination: be a contract with
the Iteo Motor iCar-company for
distribution nnd.snle, of Iteo auto
mobiles. The originul contract was
modified by subsequent agreement,
and the defendant contended there
was no acceptance of 'tbe contract
under the plaintiff's claims. The
defendant further clulmed that
the plaintiff refused to take deliv
ery of various models of automo

that no error was niado by the

Redwood Highway uiaruthon,
crossed the stato line Into Oregon ,
this morning and ut 11:25 was two
miles this side with only 42 miles
left to 'come. He had made 430
miles in the first week which eipl
ed at 11:32 today, the race having
started at that hour lust Tuesday
at Sausalito.
Flying Cloud, also of the Karook
tribe, was some distance behind
the leader. Melika, the only Zunl
competitor left in the running, wus
ten miles out of Crescent City or
77 miles from Grants Pass. '
All three leaders wero walking
today, the pace having begun to
toll ou them. Flying Cloud was
slightly ill but was exhibiting
fighting spirit and was determined
to finish second ut least. ,
Miss Redwood Empire, "Little
Fawn" of the Klamath Indians,
arrived hero today with oftlcials
of the Redwood Empire associa
tion to greet the 'runners, upon
whom she bestowed her blessing
before the start of the race. Peo
ple are arriving in large numbers
to participate iu the celebration at
the finish. An Indian dance will 1
be' given by the Karook Indians
on , Sixth Street hero tonight
when the race ends. :
