The crime grew out of a trans
action In which Cody bought two
homes from a man named Owl
field In Harney county, giving In
return a bad check on a bunk at
Elko. Nevada signing it with the
name Pried Yerdlow.
Subsequently the sheriff wont to
the Polock farm In Harney Cbusty
and placed Cody under arrest. Cody
asked permission to get his saddle
before going with the sheriff and
while doing so be armed himself.
In an exchange of shots the sheriff
was wounded In the thlph and bled
to death. Cody tied and was ar
rested the following day.
Cody must now, on official or
der, be removed from the state
penitentiary to Burns where be will
be resentenced to bans.

Intensity which swept France last

center of last night's hurricane
was the coast of Normandy, where
the deaths occurred. In Paris the
Eiffel Tower station at midnight
registered a southwesterly wind of

RIVER SWOLLEN BY
RAIN AND SNOW
In spite of the fact that the
rainfall for th month of Decem
ber is below the average, and In
fact the precipitation for the en
tire wet season Is under the nor
mal, the South Umpqua river
which flows throuKh It one bur
has been rising rapidly during the
pan 48 hours. Indicating rapidly
falling and melting snows in the
higher altitudes. The river has
been extremely low until the end
of last week, when it came up
slightly. Rains of Sunday and
Monday hare caused It to rUe to
slightly a bo ye the normal mark.
According to reports from the
weather bureau station, tho wea
ther up to the present time has
been unusually mild for Decem
ber. The coldest temperature re
corded since the. first of January
was on December 16, when the
mercury dropped to 31 degrees,
the only time during 1925 that
the f reeling mark was reached. ,
SHORT MEETING
OF CITY COUNCIL
HELD LAST NIGHT
The mid-month council meeting
held last night proved to be a
short session with an early ad
journment. ,
Contractor Halstead appeared
and reached a compromise with
the council for the settlement of
paving on Kast -ilb street. There
is one short panel on the street
in which, through an error, tho
workmen failed to put enough
concrete, sccordlng to the city in
spector. Tho city refused to pay :
for the section, and rathor than
tear it out and replace it the con
tracor agreed to eliminate lha
section from the cost of the job.
The electric light committee re
ported.that the -street lights bad
been cleared, and the action of the
committee in ordering this work
done wss ratified.
. The city recorder was atithorlz-'
ed to purchase stamps for the '
ofico.
Final estimates were allowed
on Roberts, I'a-a 4th and Kiver
side street paving jobs. .

away late yesterday, according to
word received this morning by her
son H. B. Church, a local mall
carrier. Mrs. Church was III -only
a short time before her death.
She was the mother of seven chil
dren, six of whom are still living.
H. II., Milton and Ocorge Churrk,
three of the sons, sro well known
Jiere. Mrs. Church visited In
noseburg for a short time about
six years ago. Howard Church
visited the old borne about three -years
and Milton Charch was home
last year.
