PORTLAND. Aug. 1J. The
government filed suit this morn
I ue in federal court to annul Us
grant to the North Canal Com
pany for permission to use part
of the Deschutes national forest
as an Irrigation reservoir site.
The suit also asks damages of
$47,805 to standing timber and
also for the costs of clearing
away a dam and other Improve
ments made by their irrigation
company under the project.
The government In Us suit
charged that the company had
failed to lire up to stipulations It
had made to the secretary of the
' interior January 28, 19::.
The agreement with lha govern
ment called for the company to
pay all the damages done lo roads,
cabins, te.ephone lines and market
able timber within the forest re
serve. It' called for removal of brush
and dead timber on the site of 'he
reservoir, for paying all damages
caused by overflows or leakages ct
water from the reservoir and for
building and maintaining a cross
ing over the flood waters at the
suggestion of the forest supervisor.
It was a'so agreed by the comp
any 'to build new roads and trails
and other Improvements as re
quired by the supei visor. '
